Section 4.06 Appeals

Where Supervisors Refuse Approval Appeals to the Court of Common Pleas of Bucks County shall be governed by the Pennsylvania Municipalities Planning Code.

Section 4.07 Recording Final Plans for Minor Subdivisions

Major Subdivisions and Land Developments Upon approval of a final plan 'of a subdivision or land development the applicant shall, within ninety (90) days of such final approval, record the plan in the office of the Recorder of Deeds of Bucks County. The applicant shall notify the Board of Supervisors in writing, of the date of such recording and the plan book and page wherein the subdivision or land development plan is recorded. If the plan is not recorded within the ninety (90) day period, the approval shall lapse and become void, unless otherwise specified by the Board of Supervisors.

Section 4.08 Effect of Recording

A. Streets, parks and other public improvements shown on a subdivision or land development plan to be recorded, may be offered for dedication to the Township by formal notation thereof on the plan; or the owner may note on the plan that such improvements have not been offered for dedication to the Township.

B. Every street, park, or other improvement shown on a subdivision or land development plan that is recorded, as provided herein, shall be deemed to be a private street, park, or improvement until such time as the same has been offered for dedication to the Township, and accepted by resolution, and recorded in the Office of the Clerk of the Court of Common Pleas of Bucks County, or until it has been condemned for use as a public street, park, or other improvement.

Section 4.09 Registration of Agricultural Subdivisions

The subdivision of land for agricultural purposes into parcels of ten (10) acres or more, not involving any new street or easement of access, shall be exempt from this subdivision ordinance. To ensure compliance with the criteria for exemption, no one shall effect a subdivision of land for agricultural purposes into lots of ten (10) acres, unless the individual receives the approval of the Township Board of Supervisors based upon the applicant's written proof that:

A. All proposed parcels shall be at least ten (10) acres in size.

B. All parcels shall be used only for agricultural purposes as defined by this Ordinance.

C. No new street or easement of access shall be involved.

D. In addition to the notarized statement acknowledging ownership, the following statement shall appear on the record plan, "All lots shown hereon are at least ten (10) acres in area and are to be used exclusively for agricultural purposes as defined by the Solebury Township Subdivision and Land Development Ordinance."

E. The following procedures shall be followed to obtain certification:

1. The plan requirements of Section 4.01 D., of this Ordinance, shall be met. Statements shall be included on the plan certifying the above.

2. The applicant shall submit the required number of plans for certification (See "Suggested Information for Applicants For Subdivision and Land Developments")

3. Within sixty (60) days the Solebury Township Planning Commission shall review the plan and render its decision in writing to the applicant.

4. If approved the Planning Commission will sign the record plans. Two linen copies shall be signed.

5. If the Planning Commission finds that the proposal is not consistent with the agricultural subdivision criteria, the applicant will be notified that the subdivision procedures and requirements of this ordinance shall be complied with.

Section 4.10 Conditional Approval

1. An application may be granted preliminary or final approval subject to specific conditions which must -be accepted or rejected by the applicant in accordance with subsection 2. hereof provided the applicant grants an extension of thirty (30) days within which the Township can take action if the conditions a-re rejected. These conditions shall be included in a written communication to the applicant.

2. Within seven (7) days of the applicant's receipt of the grant of conditional approval by the Board of Supervisors, the applicant shall notify the Township in writing of the applicant's acceptance or rejection of the conditions of approval. If the applicant does not so notify the Township within seven (7) days, approval of the plan shall automatically be rescinded. If the conditions are rejected, the Township shall take official action on the application within the time limit established by the extension of time.
