H. At the request of the applicant, the Township shall furnish the applicant with a signed copy of a resolution indicating approval of the applicant's final plan contingent upon the applicant obtaining a satisfactory financial security. The final plan will not be signed by the Board of Supervisors until a satisfactory financial security is presented. The resolution of contingent approval shall expire and be deemed to be revoked if the financial security agreement is not executed within ninety (90) days, unless a written extension is granted by the Board of Supervisors.

Section 4.04 Sketch Plan - Minor Subdivisions

A. Purpose

In the case of minor subdivisions, as defined in Section 3.91, it is the purpose or this section to provide a simplified procedure by which said minor subdivisions may be submitted and approved. The sketch plan step is not a formal application. The procedure is provided for the applicant of a minor subdivision who -may have questions regarding compliance with the Township ordinances and who would like to obtain the informal comments of the Township prior to having the formal submission prepared.

B. Application Procedure

The Township Planning Commission will review the sketch plan submission and advise the applicant how the proposed subdivision may conform or fails to conform to the requirements of this Ordinance and other applicable ordinances. The applicant is advised to attend a meeting of the Township Planning Commission to present and discuss his proposal. The Boar of Supervisors will conduct a review and discuss the plan with the applicant if requested by the applicant or Planning Commission.

C. Data Recommended for a Sketch Plan

Although the amount of information submitted at this stage is at the option of the applicant, it should be recognized that well researched information can minimize expense at the final plan stage and simplify the review. Anyone submitting a Sketch Plan should refer to Section 4.01 D. for suggested plan information.

Section 4.05 Final Plan - Minor Subdivision

A. Purpose

The purpose of the final plan stage is to insure formal approval by the Solebury Township Board of Supervisors before a plan for minor subdivision is recorded as required by Section 4.07 of this Ordinance.

B. Application Procedure

1. The Minor Subdivision submission shall be in accordance with "SUGGESTED INFORMATION FOR APPLICATION FOR SUBDIVISION AND LAND DEVELOPMENT".

2. No final plan shall be accepted by the Township unless the appropriate fee in accordance with current fee schedule adopted by resolution by the Board of Supervisors shall be paid in cash or certified check at the time of submission to the Township.

3. The final plan shall be clearly labeled as a final plan.

4. Where any revision is made, or when the plan is a revision of a previously approved final plan, solid lines shall show the currently proposed features. A symbol and reference number shall identify the aspect revised on the field of the drawing. All revisions shall be noted in a revision block and listed by symbol and reference number. An explanation of each revision shall be included in the revision block.

5. Within the time limits established by the Municipalities Planning Code the Board of Supervisors shall:

a. Review the applicant's submission.

b. Review any reports submitted by the Township Planning Commission and other applicable reviewing agencies.

c. Listen to the applicants presentation if requested.

d. Render its decision within the provisions of the statute in writing and this shall be sent to the applicant by mail at the address provided by the applicant on the application form.

e. When the application is not approved as filed, the decision shall specify the defects found in the application and describe which requirements have not been met and cite the provisions of the statute or ordinance.

6. Any individual or entity submitting required plans for a minor subdivision or a land development shall notify all individuals or entities who own real estate within five hundred (500) feet of the proposed minor subdivision or land development of the pendency of such minor subdivision or land development proposal in writing on a form approved by the Township. Such notice shall be made by regular mail to the landowner's last known address. The address on the tax rolls shall be considered the last known address. Such notice shall be mail within five (5) days of the submission of the first required plan. Verification of mailing, including a copy of the names, addresses and tax parcel numbers of each person to whom notice was mailed, shall be given to the Township within fifteen (15) days of the submission.

C. Size and Scale of Plans

The final plans shall be prepared in accordance with the specifications and requirements of Section 4.02.C.

D. Required Information

1. Site Survey

a. Name of the proposed subdivision or identifying title.

b. Name and address of the owner of record of the property to be subdivided, any authorized agent, and the applicant.

c. Name and address of the owner of record of the property to be added to and any authorized agent, and the applicant.

d. Name of the professional land surveyor responsible for the property survey in accordance with Act 367 of 1979.

e. Municipality in which the subdivision or land development is located.

f. North point, date and scale (written and graphic).

g. Tax map lot numbers of the property to be sub-divided and the property to be added to.

h. A location map for the purpose of locating the site at a scale not less than eight hundred (800) feet to the inch. showing the relation of the tract to adjoining property and to all streets, roads, zoning districts, and municipal boundaries existing within sixteen hundred (1,600) feet of any part of the property.

i. The names of owners and tax map numbers of land immediately adjacent or across contiguous highways, streets and roads, and the names of proposed or existing subdivisions and land developments immediately adjacent or across contiguous highways, streets and roads.

j. All existing highways, streets and roads on, adjacent to, or within four hundred (400) feet of any part of the tract, including name, right-of-way width and cartway width.

k. All existing buildings and their uses, bodies of water, sewers, water mains, on-site septic systems and wells, culverts, petroleum or petroleum product lines, gas lines, electric and telephone lines, fire hydrants, all other utilities and other significant man-made features on the tract.

l. All existing property lines, easements and rights-of-way, and the purpose for which the easements have been established.

m. Pursuant to Act 287 of 1974 all underground utility lines shall be shown on the plan. The type of line, the utility company owning the lines, the size of the line, and the width of any right-of-way or easement shall be shown.



n. Site. boundaries (bearings in degree, minutes and seconds, and distances to the hundredth of a fool).

0. Total acreage of the tract to the thousandths of an acre and in hundredths of square feet.

p. List the date and all references to any subdivision which increased or decreased the size of the subject tract since July 5, 1967.

2. Natural Features Map

The following information may be shown superimposed upon a copy of the survey map or may be submitted as a separate sheet.

a. Flood plain areas

The portion of land, if any, within the Floodplain District of Solebury Township and the identification of the land within the Floodplain District which shall include areas subject to inundation by waters of the 100 year flood. The basis for the delineation of this District shall be the current Flood Insurance study for the Township prepared by the Federal Insurance Administration. In those areas of the Township which are not included within the aforementioned Flood Insurance Study, the Floodplain District shall be defined as that area including all soils mapped by the Soil Survey of Bucks and Philadelphia Counties, Pennsylvania, prepared by the Soils Conservation Service, as alluvial soils,' including but not limited to, Alton Gravelly Loam, flooded; Bowmansville Silt Loam; Hatboro Silt Loam; Marsh; Pope Loam and Rowland Silt Loam.

b. Flood plain soil areas.

c. General slope areas. The Soil Survey of Bucks and Philadelphia Counties, Pennsylvania, may be used for identification.

d. The location of forests and of isolated trees of four (4) inches caliper or more.

e. Streams.

f. Lakes and ponds.

g. Wetlands.

h. Rock outcroppings.

i. The boundaries of the various soil types and identification keys as indicated in the Soil Survey of Bucks and Philadelphia Counties, Pennsylvania, with a description of each soil type and limitations of the soils-for on-site sewage disposal.

j. Name of the engineer or other professional person responsible for the Natural Features Map.

3. Site Plan of Proposed Project

The following information may be shown superimposed upon a copy of the survey map or may be submitted as a separate sheet.

a. Name of the proposed subdivision or identifying title.

b. Name and address of the owner of record of the property, any authorized agent and the applicant(s).

c. Name and address of the owner of record of the property to be added to and any authorized agent, and the applicant.

d. Name and address of the engineer, surveyor, architect, or landscape architect responsible for the plan.

e. Zoning requirements, including:

i. applicable district.

ii. maximum density permitted and proposed density.

iii. required and proposed lot sizes.

iv. required and proposed open space and impervious surface ratios if applicable.

v. any variances, conditional uses or special exceptions granted.

vi. minimum building setback lines (front, side, and rear) for each lot.

vii. lot width requirements.

viii. buffer yards.

f. A location map for the purpose of locating the site at a scale no less than eight hundred (800) feet to the inch, showing the relation of the tract to adjoining property and to all streets, roads, zoning districts and municipal boundaries existing within sixteen hundred (1,600) feet of any part of the property.

g. North point, date and scale (written and graphic).



h. Site boundaries.

i. All existing highways, streets and roads on, adjacent to, or within four hundred (400) feet of any part of the tract, including name, right-of-way width and cartway width.

j. Types and locations of proposed buildings.

k. Resource protection areas.

1. Size of the parcel of land to be transferred to the thousandth of an acre and in hundredths of square feet.

m. The size of each parcel of land after the transfer has taken place to the thousandth of an acre and in hundredths of square feet.

n. Setbacks and yard requirements as specified in the Solebury Township Zoning Ordinance along the proposed lot line. Any proposed or existing building which would be located within the proposed setback or yard requirement shall be illustrated on the Site Plan.

4. Sewage Disposal Systems

a. All applicants and/or property owners must submit written documentation from the Bucks County Department of Health stating whether any existing on-lot sewage disposal system is permitted or is subject to a rural residence exemption together with their application.

b. Where a subdivision or lot line change is proposed for a property, which is determined by the Department of Health to be subject to the rural residence exemption, the applicant or property owner must obtain a permit for the sewage disposal system which will serve the newly created lots, and must satisfy all of the requirements of Section 4.02.D.12 of the Solebury Township Subdivision and Land Development Ordinance. If the applicant or property owner is unable to obtain a permit for the existing system, the applicant or property owner shall be required to obtain a permit for a replacement sewage disposal system.

c. If a permit is not on file with the Department of Health for the existing system, and the property is not subject to the rural residence exemption, the applicant or property owner must obtain a permit for a new system if the parcel containing the existing system will be less than five (5) acres.

d. If there is a permit on file for the existing system, the applicant or property owner must submit written documentation to the Township that the existing system is not visibly malfunctioning to the surface of the ground, has not been implicated in the contamination of any drinking water supply or surface water body, is. currently in satisfactory structural condition and appears to have been maintained in a satisfactory manner from a registered professional engineer before a subdivision or lot line change is finally approved.



e. The information requirements of Section 4.05 D.1 and 2. may be varied by the Solebury Township Board of Supervisors if the Board of Supervisors find the specific requirements to be inappropriate, unnecessary or present a hardship as defined in Section 2.00 of this Ordinance.

F. Approval of Plans

1. Before final plan approval is granted-, the applicant shall:

a. Obtain the easements and releases required by this Ordinance.

b. Reimburse the Township promptly for attorney's and engineer's fees and fees for other professionals employed by the Township to review or process subdivision plans.

2. If approved by the Board of Supervisors, two (2) exact copies of the approved final plan on linen cloth shall be submitted for the required signatures.

a. Appropriate approval blocks (See Section 4.03 G.3.) shall appear on the first sheet or title sheet of the set of plans. All approved final plans shall be signed by the Township Engineer, a designated member of the Planning Commission and the Board of Supervisors. Such signatures shall be placed only on linen prints of the approved plan. All sheets other than the first, shall be date stamped, approved and marked for identification purposes.

b. Before acting on any subdivision plan, the Board of Supervisors may hold a public hearing thereon after public notice.

3. If approved by' the Board of Supervisors, one (1) exact black-line transparent overlay showing roads, lot lines, streams, lakes and ponds shall be submitted at a scale of 1" to 800' foe use by the Township in updating the Township base map.

4. The provisions of this section shall not relieve the developer from the penalties provided for in the Pennsylvania Municipalities Planning Code for violations of this Ordinance.
