ARTICLE V Provisions Applicable to Both Boards
§132-24. Rules and Regulations (by-laws).

The Boards shall adopt such rules, regulations and by-laws as may be necessary to carry into effect the provisions and purposes of this Ordinance.

§132-25. Attorney, Experts and Staff.

Each Board may employ or contract for and fix the compensation of legal counsel, other than the Municipal Attorney, and experts and other staff and services as it may deem necessary, not exceeding, exclusive of gifts or grants, the amount appropriated by the Township Council for its use.

§132-26. Financial/Personal Interest.

No member shall be permitted to act on any matter in which he has, either directly or indirectly, any personal or financial interest.

§ 132-27 Site Plan Approval

The applicable Board pursuant to 40:55D-1 et. seq shall approve subdivision plats as a condition for the filing of such plats with the County Recording Officer. The applicable Board pursuant to 40:55D-1 et. seq shall also approve of site plans as a condition for the issuance of a permit for construction of all new buildings and additions to all existing buildings, except for detached one or two dwelling unit buildings and accessory agricultural buildings not exceeding 12,500 square feet to support existing agricultural uses on-site.

The Director of Planning & Engineering or designee ma waive the site elan a royal requirement if the new construction addition or chance in use or occupancy does not have a substantive effect on factors such as existing site circulation stormwater runoff, landscaping, lighting parking and other typical considerations of site plan review.

§132-28. Pre-application Meetings.

Before filing a formal application in accordance with the procedure set forth in this Article, applicants are encouraged to meet with the Township's technical personnel, including the Planning Management staff, Township Engineer, Construction Official, and Fire, Police and Health Departments, where appropriate, prior to submitting a formal application for development. The purpose of the informal meeting is to make the applicant aware of the specific requirements applicable to the area, or type of development being considered.

§ 132-29. Application Submittal.

An application for the development of land shall be submitted with the required fees, and all required submissions as set forth under checklists below to the Director of Planning and Engineering or his designee. The Director of Planning and Engineering, or his designee shall (a) review the application to determine its completeness; (b) determine the type of development action required; and (c) forward the application to the proper board or agency for subsequent action.

A. Incomplete Application

If found to be incomplete, the application shall be returned to the applicant within forty-five (45) days of submission with information as to what is lacking.

B. Complete Application

An application for development shall be complete for purposes of commencing the applicable time period for action by a municipal agency when 'so certified by the Director of Planning and Engineering or his designee. In the event that the Director of Planning and Engineering or designee does not certify the application to be complete within 45 days of the date of its submission, the application shall be deemed complete upon the expiration of the 45 day period for purposes of commencing the applicable time period.

C. Within the required time period the completed application and site plan shall be set down for hearing before the Planning Board which shall review the site plan to ensure that it complies with the following standards and regulations:

(1) The application and site plan contain all of the items and information required under ordinances of the Township of East Brunswick.

(2) The proposed buildings, structures and use are in accordance with the standards of this chapter and all ordinances of the Township of East Brunswick, including the Master Plan of the Township of East Brunswick as may be in existence at the time of the application.

(3) The application and site plan provide a storm water management proposal meeting the goals and objectives of Township Ordinances.

(4) Adequate provisions are made to screen all playgrounds and parking, service and storage areas from the view of adjacent properties and streets, during all seasons of the year, whenever the Planning Board shall determine that such screening is necessary to protect the health, safety or general welfare of the public.

(5) The location, intensity and direction of all outdoor lighting is such that it will not have an adverse effect upon the existing or future use of adjoining properties.

(6) Bikeways are installed or easements therefor granted to the township, in accordance with the provisions of § 192-40 of the Code of the Township of East Brunswick. [Added 2-9-76 by Ord. No. 76-8-AAA]

(7) Sidewalks are installed, wherever so required by the Planning Board, in accordance with the provisions of & 192-19 of the Code of the Township of East Brunswick and that ramp access of a type approved by the Planning Board is provided to allow access to all public buildings by the physically handicapped.

The file shall be either an AutoCAD drawing file compatible AutoCAD Release 10 or an ACSII drawing interchange file compatible with AutoCAD Release 1 0. [Added 8-23-93 by Ord. No. 93-48]

The following shall be on the plans submitted:

( ) Entire tract shown on one sheet

( ) Plat based on a new or existing survey of the property being subdivided, as per revised statutes title 45:8

( ) Plans signed and sealed by a New Jersey Licensed Land Surveyor

( ) The tract name, tax map sheet, block and lot number, date, reference meridian, scale and the following names and addresses:

( ) The record owner or owners

( ) The subdivider

( ) The person who prepared the map

( ) Acreage of tract to be subdivided to the nearest hundredth of an acre

( ) Accurate length of all existing and proposed lot lines

( ) Tract boundary lines, right-of-way lines of streets, street names, easements and other rights-of-way, land to be reserved or dedicated to public use, all lot lines and other site lines; with accurate dimensions, bearings or deflection angles, and radii, arcs and central angles of all curves.

( ) The purpose of any easement or land reserved or dedicated to public use shall be designated, and the proposed use of sites other than residential shall be noted.

( ) Each block and the lots within each block numbered in accordance with a numbering system provided by the Municipal Engineer

( ) Minimum building setback line on all lots and other sites

( ) Location and description of all existing and proposed monuments

( ) Names of owners of adjoining land

( ) Certification by a Licensed New Jersey Land Surveyor as to the accuracy of details of the plat, as required by law

( ) Certification that the applicant is agent or owner of the land or that the owner has given consent under an option agreement

( ) When approval of a plat is required by an officer or body of such municipality, county or state, approval shall be certified on the plat

( ) Cross sections and profiles of streets, approved by the Township Engineer

( ) Plans and profiles of storm and sanitary sewers, water mains and hydrants approved by the Township Engineer, Health Officer and Sewerage Authority. All plans and profiles for gas, electric and telephone utilities are to be approved by the appropriate utility company.

( ) Final grading plans showing two foot contours, the proposed solutions to difficult drainage problems that might be encountered as a result of the finished grades and the location and elevation of the main levels of each building.

( ) "Letter of Intent" detailing size of proposed building, proposed use, number of tenants, number of employees, anticipated hours of operation, traffic, etc.

( ) Evidence of soil erosion and sediment control plan submittal to Freehold Soil Conservation Service (if disturbance of 5,000 square feet or more of soil)

( ) Evidence of submittal to New Jersey Department of Environmental Protection for stream encroachment permit or determination (it applicable)

( ) A statement indicating that the property which is the subject of the application for development is free of delineation as a freshwater wetland, as more particularly defined in N.J.S.A. 13:913-3 et seq, or if any part of the property which is the subject of the application for development is delineated as "freshwater wetland", then the applicant shall show such areas on a survey of the property, prepared by a licensed surveyor of the State of New Jersey.

( ) Evidence of submittal to Middlesex County Planning Board (if on County road or involving County drainage structure)

( ) Any other documents deemed necessary for a thorough review, as required by the Department of Planning and Engineering. These additional documents may include, but are not limited to, descriptive indications of ingress and egress, parking, walkways, fencing, drainage, exterior lighting, building floor plans, front, side and rear elevations, freestanding signs and landscaping.

( ) Location of all existing and proposed storm drainage structures and utility lines including telephone, power, water, sewer, gas, etc., whether publicly or privately owned, with pipe sizes, grades and direction of flow

( ) Names of all owners of record of all adjoining property, and property directly across the street or streets from the property involved, and the block and lot numbers of all the property shown on the plan

( ) Plans and profiles of all proposed utility layouts, including storm drainage, sanitary sewers and waterlines, showing feasible connections to existing utility systems or to proposed systems, which will be installed before the plat is submitted for final approval

( ) Statement of the steps to be taken by the subdivider to eliminate any downstream drainage problems which may be caused by the development of the subdivision and to mitigate impact from prior upstream development



( ) If fixtures other than Public Service Electric and Gas or Jersey Central Lighting, the location, direction of illumination and intensity of all outdoor lighting. Type of fixture and height of lighting are to be indicated and isolux lines are to be superimposed on the plan.

( ) Manufacturers catalogue cut sheet for proposed lighting

( ) Location of all land which lies within the 100 year flood line as depicted on the current State of New Jersey, Department of Environmental Protection, Division of Water Services, Bureau of Flood Plain Management, Delineation of Floodway and Flood Hazard Area Maps.

( ) Location of all areas with seasonal high-water table at the surface, including lakes and ponds.

( ) Location of all areas with seasonal high water table within one and a half (1 -1 /2) feet of the surface.

If the N.J. Dept. of Environmental Protection deems that wetlands are present, or the applicant does not receive a response to its request for a letter of interpretation, the applicant shall show such areas on a survey of the property, prepared by a Licensed Surveyor of the State of New Jersey.

( ) Evidence of submittal to Middlesex County Planning Board (if on County road or involving County drainage structure)

( ) Storm drainage calculations in accordance with Chapter 192 [Amended 8-23-93 by Ord. No. 93-48]

( ) Environmental Impact Assessment Report in accordance with Chapter 132 [Amended 8-23-93 by Ord. No. 93-48]

( ) Copy of any protective covenants or deed restrictions that are intended to cover all or any part of the tract

( ) A written statement setting forth the intentions of the applicant in regard to the proposed character of the subdivision, whether for the sole purpose of the sale of land or for the construction and sale of homes, with data as to the number, price range, size, floor plan and the outside design of homes, deed restrictions, date of beginning and completion of construction and proposed method of maintaining parking or recreational areas. The statement shall also contain an acknowledgment that the applicant is familiar with the Township's Look Alike Ordinance and Tree Removal Ordinance and will abide by the terms of both ordinances.

( ) The density of land use to be allocated to various parts of the site.

( ) The location, type, standards and size of recreational and community facilities of all open space.

( ) The form or organization proposed to own and maintain common open space.

( ) The substance of any covenants, grants, easements, or any covenants proposed to be imposed upon the land or buildings, including easements for public utilities, to the extent known.

( ) The projected schedule for development and the appropriate times when final approvals would be requested.

( ) A statement of why the public interest would be served by the proposed development, such statement to be supported by a detailed economic, social and physical study.

( ) The proposed number of bedrooms for all dwelling units.

( ) Delineation of pedestrian walkways, nature paths and bicycle paths, which must be in conformance to any adopted master plan for bicycle paths.

( ) Such other items and information pertaining to the site as the Department of Planning and Engineering reasonably determines would be necessary or helpful to the Planning Board in reviewing the application.

( ) Environmental Risk Audit in accordance with Township Code Chapter 132-58.1-I(2) [Added 7-8-91 by Ord. No. 91-82; amended 8-23-93 by Ord. No. 93-48]

( ) Recycling Plan, which shall include details as to the storage, collection, disposition and recycling of recyclable materials as listed in Chapter 1 14. [Added 7-8-91 by Ord. No. 91-82]
