Section 1304 - Dimensional Standards And Density Determination

Note: The zoning provisions described below for the "Conservation Design Overlay District" offer four options for varying intensities of development linked to different percentages of open space.

A. Dimensional Standards for Option 1: Neutral Density and Basic Conservation

1. Density, Factor

One dwelling unit per 1.75 net acres as determined through the Adjusted Tract Acreage approach or Yield Plan described in Section 1304-C, herein. This is "density-neutral" with the pre-existing zoning provisions for this district.

2. Minimum Required Greenspace Land:

a. The subdivision must include at least 50 percent of the Adjusted Tract Acreage as Greenspace Lands. Greenspace Lands shall not be used for residential lots, except as provided below.

b. Large "conservancy lots" of at least 10 acres, conforming to the standards for Option 3 subdivisions found in Section 1304.D, and owned by individuals may occupy up to 50 percent of the Greenspace Land, with the remainder (not less than 50%) deeded to a homeowners' association (with easement to the London Britain Township Land Trust), or London Britain Township Land Trust. However, the Greenspace Lands within each conservancy lot remains subject to the standards for Greenspace Lands in Section 1306A, herein. Any livestock kept on such lots shall be confined to areas where fencing prevents them from entering streams or creeks, except where crossings are necessary. Creeks and streams shall be re-forested if needed to within 25 feet of the creek as defined by state standards.

3. Average Minimum Lot Area: 32,000 square feet. Up to thirty (30) percent of the lots may be reduced to a minimum of 21,000 square feet with off lot common sewer. .

B. Dimensional Standards for Option 2: Enhanced Density with Greater Conservation

1. Off lot common sewer shall be provided for all dwelling units.

1. Density Factor: One dwelling unit per 1.35 net acres (56,200 sq. ft.) as determined through the Adjusted Tract Acreage approach or Yield Plan described in Section 1304.C herein.

2. Minimum Required Greenspace Land: .

a. The subdivision must include at least 60 percent of the Adjusted Tract Acreage as Greenspace Land. Greenspace Land shall not be used for residential lots, except as provided below.

b. Large "conservancy lots" of at least 10 acres, conforming to the standards for Option 3 subdivisions found in Section 1304.D, and owned by individuals may occupy up to 50 percent of the Greenspace Land, with the remainder (not less than 50%) deeded to a homeowners' association with easement to London Britain Township Land Trust, London Britain Township Land Trust, or the municipality. However, the Greenspace Land within each conservancy lot remains subject the standards for Greenspace Land in Section 1306- A, herein. Any livestock kept on such lots shall be confined to areas where fencing prevents them from entering streams or creeks, except where crossings are necessary. 3. Average Minimum Lot Area: 21,000 square feet, on average. Up to twenty (20) percent of the lots may be reduced to a minimum of 10,000 square feet with off lot common potable water supply.

6. Yard Regulations: The builder or developer is urged to consider variations in the principal building position and orientation, but shall observe the following minimum standards:
