If OWNER fails to complete said work or improvements within one (1) year from the date hereof, OWNER acknowledges that OWNER is then in default under this agreement and that TOWNSHIP may, at its option, after notice in writing, enter into possession of the premises, complete the said work by contract, with a reputable contractor and the full cost of so doing will be the measure of damages due to said failure on the part of OWNER and TOWNSHIP shall collect the full cost of doing so from the Letter of Credit from BANK.

4. That no road or roads or curbs shall be constructed between October 15th and April 15th of the year. Where grading is such that surface water drains along the swale or ditch at the rear of properties, the deeds shall contain a restriction requiring that no change in grade will be permitted in the line of such swale or ditch nor any obstruction be placed in such a way as to interfere with such surface drainage.

5. That OWNER agrees to maintain barricades as are necessary during the course of construction of the improvements so as to give all reasonable protection to the traveling public and to maintain-such warning lights or flares as are necessary for this purpose.

OWNER hereby agrees to indemnify TOWNSHIP for any monies paid or recovered against TOWNSHIP arising out of OWNER's negligence, or otherwise, in performing the work contemplated by this Agreement. Further, OWNER hereby agrees to furnish TOWNSHIP a certificate establishing that OWNER carries Public Liability and Property Damage Insurance in an amount not less than $300,000.00/ $500,000.00/$1,000,000-00 and that the interests of TOWNSHIP are protected and covered by said insurance and that TOWNSHIP is insured by and under said Policy as an "Additional Insured."

6. That at all times prior to acceptance by TOWNSHIP, OWNER agrees that OWNER shall keep roadways free from obstructions, including ice, snow, debris, equipment, etc., the removal of which from said roads shall be the sole responsibility of OWNER.

7. That when the improvements hereinabove referred to are completed to the satisfaction of TOWNSHIP, OWNER shall dedicate any and all roads to TOWNSHIP by a Deed in the form approved by the Township Solicitor, plus a plan of the roadway dedicated, title to the roadway to be such as will be insurable by a reputable Title Insurance Company of Pennsylvania at regular rates, all costs in connection therewith to be borne by OWNER.
