ARTICLE VII Business District (B)
§160-23. Permitted uses.

Within any Business District (B) a building, structure, lot, or land shall be used only for one of the following principal uses:

A. Stores fronting only on Sagamore Avenue for the retail sale of food, drugs, clothing and other daily necessities of community life with the exception of motor and heating fuels.

B. Business and professional offices fronting only on Sagamore Avenue in which no manufacturing takes place.

C. Shops fronting only on Sagamore Avenue for repair and services which are maintained solely for the purpose of repairing and maintaining homes and home equipment and furnishings, personal property and personal items, other than motor vehicles and gasoline powered equipment.

D. Railroad station.

E. Fire station, village office or any government building of a similar character.

F. Village park, playground or recreational area.

G. Existing one-family detached dwelling and existing two-family dwellings on lots in the block bounded by Sagamore Avenue, Prospect Street, Post Lane and Ogden Avenue.

H. New one-family dwellings conforming to the Residence B District dimensional regulations.

§160-24. Conditional uses.

Within any Business District (B), a building, structure, lot or land may be used for the following conditional use when authorized by the Board of Trustees pursuant to §160-40:

A. Florist and greenhouse as they existed prior to the enactment of this section, provided that any change of the physical character of the premises or the extent of the use requiring a building permit or certificate of occupancy shall be subject to the conditional use review and approval procedure, and further provided that in the event of destruction of the prior existing use through fire or other catastrophe, such use may be restored or rebuilt as it existed prior to such catastrophe.

§160-25. Accessory uses.

A. Customary accessory structure and/or use, except those prohibited by this chapter, pursuant to §160-32.

B. Signs pursuant to §160-35.

C. Private garage or private off-street parking area pursuant to §160-36.

§160-26. Dimensional regulations.



Any building, structure, lot or land shall only be used in conformance with the following dimensional regulations, except where a more stringent requirement is established for a conditional use:

A. Building height.

(1) All main or principal buildings shall be no more than 2 1/2 stories in height with a maximum height of 29 feet. [Amended 5-11-1998 by L.L. No. 4-1998]

(2) Accessory buildings and structures shall have a maximum height of 16 feet and be no more than one story high.

B. Minimum lot area and width. Five-thousand-square-foot lot area with fifty-foot width at the street line.

C. Maximum lot coverage.

(1) Building area: 35% of the lot area.

D. Minimum habitable floor area. Same as Residence B District.

E. Minimum front yard depth: 10 feet.

F. Minimum side yard depth.

(1) Total of two side yards: no requirement.

(2) Minimum, one yard: 10 feet, if provided.

G. Minimum rear yard depth: 20 feet.
