ARTICLE VI Multifamily Residence District (RM)
§160-19. Permitted uses.



Within any Multifamily Residence District a building, structure, lot or land shall be used only for one of the following principal uses:

A. One-family detached dwellings.

B. Fire station, municipal office or any governmental building of a similar character.

C. Village park, playground or recreational area.

§160-20. Conditional uses.

Within any Multifamily District a building, structure, lot or land shall have the same conditional uses as in Residence A District (RA) and the following conditional use pursuant to §160-40:

A. Multifamily dwelling.

§160-21. Accessory uses.

Within any Multifamily Residence District the following buildings, structures and uses will be permitted or conditionally permitted as accessory uses to a permitted principal use or a conditional use respectively located on the same lot or land:

A. Customary accessory structure and/or use, except those prohibited in this chapter pursuant to §160-32.

B. Signs pursuant to §160-35.

C. Private garage or private off-street parking area pursuant to §160-36.

D. Private swimming pool pursuant to §160-38.

§160-22. Dimensional regulations.

Any building, structure, lot or land shall only be utilized in conformance with the following dimensional regulations, except where a more stringent requirement is established for

A. Building height.

(1) All main or principal buildings shall not be less than two stories high and have a peaked roof, and, further, they shall not exceed 2V2 stories. The maximum height of any building shall be 29 feet, except as provided in §160-34. [Amended 5-11-1998 by L.L. No. 4-19981

(2) Accessory buildings and structures shall have a maximum height of 16 feet and be no more than one story high.



B. Minimum lot area and width.

The minimum lot area per family for multifamily dwellings shall be 1,500 square feet per family with a total minimum lot area of one acre and two hundred-foot width at the street line, and for one-family dwellings six-thousand-square foot lot area with sixty-foot width at the street line.

C. Maximum lot coverage.

(1) Building area: 35% of the lot area.

D. Minimum habitable floor area.

(1) Multifamily dwellings: 800 square feet per dwelling unit.

(2) One-family dwellings: 1,200 square feet total area per dwelling unit, 700 on the first floor.

E. Minimum front yard depth.

The average front yard depth on the same side of the street between the two intersecting streets closest on either side of such lot where a majority of the lineal front feet between the two are on improved lots. On streets where a majority of the lineal feet have not yet been improved the minimum front yard depth shall be 20 feet.

F. Minimum side yard depths.

(1) Multifamily dwellings:

(a) Total of two side yards: 40 feet.

(b) Minimum one yard: 20 feet.

(2) One-family dwellings:

(a) Total of two side yards: 15 feet.

(b) Minimum one yard: five feet.

G. Minimum rear yard depth: 20 feet.
