Section 6.2.1 Establishment of Zoning Districts

The territory of the Township of Berkeley Heights is hereby divided into the following Zoning Districts:

R-20 Residential Zone

R-15 Residential Zone

R-15A Residential Zone

DD Downtown Development Zone

DMX Downtown Mixed Use Zone

HB-2 Housing-Business Zone

HB-3 Housing-Business Zone

DH-12 Downtown Housing Zone

DH-18 Downtown Housing Zone

DH-24 Downtown Housing Zone

AH-1 Attached Housing Zone

AH-3 Attached Housing Zone

AH-4 Attached Housing Zone

AH-5 Attached Housing Zone

AH-6 Attached Housing Zone



AH-7 Attached Housing Zone

OR Office and Research Zone

OR-B Office and Research Zone

LI Light Industrial Zone

OL Open Land Zone

Section 6.2.2 Zoning District Map

Except as otherwise specifically described in this Ordinance, the aforesaid Zoning Districts are hereby established by the designation, locations and boundaries set forth and indicated on the Zoning District Map. Said map shall be known as the "Zone Map, Township of Berkeley Heights, Union County, New Jersey" September 2007, prepared by Harbor Consultants, and is hereby declared to be a part of this Ordinance.

LEGAL DESCRIPTION

PROPOSED NEW ZONE LIMIT LINE

TOWNSHIP OF BERKELEY HEIGHTS

UNION COUNTY, NEW JERSEY

Proposed new Zone Limit Line located within Lot 2, Block 4102, Township of Berkeley Heights, Union County, New Jersey, as shown on a certain map entitled, "Proposed Zone Change Map for OR-A ZONE and OR ZONE South of Route 78, Township of Berkeley Heights, Union County, New Jersey," prepared by Schoor DePalma, dated 3/14;06, and being more particularly described as follows:

Beginning at a point in the southeasterly right-of-way line of Interstate Highway Route 78, said point being the following five courses from the intersection of said right-of-way line with the northerly right-of-way line of Plainfield Avenue (variable width), and running; thence,

a. North 88 degrees 10 minutes 38 seconds East, 15.23 feet; thence,

b. North 62 degrees 14 minutes 02 seconds East, 274.69 feet; thence,

c. North 66 degrees 41 minutes 45 seconds East, 606.26 feet; thence,

d. North 64 degrees 53 minutes 45 seconds East, 665.08 feet; thence,

e. North 56 degrees 06 minutes 40 seconds East, 63.13 feet to the true point and place of beginning; running thence,

Along the "Proposed OR-A / OR-B Zone Line and Connell III, IV and V / Hotel Property Line" as laid out on the aforementioned map, the following four (4) courses:

1. South 30 degrees 37 minutes 11 seconds East, 813.47 feet to a point of curvature; thence,

2. Along a curve to the left having a radius of 40.00 feet, a central angle of 82 degrees 38 minutes 32 seconds and an arc length of 57.70 feet to a point of tangency; thence,

3. North 66 degrees 44 minutes 17 seconds East, 79.10 feet to a point of curvature; thence,

4. Along a curve to the left having a radius of 388.00 feet, a central angle of 19 degrees 37 minutes 13 seconds and an arc length of 132.87 feet to a point of non- tangency intersecting the existing zone line and lot line dividing Lot 1.01, Block 4301 and Lot 2, Block 4102 as shown on a map entitled "Boundary Survey for Connell Properties, Lot 2, Block 4101 - Lots 1 & 2, Block 4102, Lots 1 & 2, Block 4103 - Lot 1.01, Block 4301, Township of Berkeley Heights, Union County, N.J., Lot 4, Block 70.08, Borough of Watchung, Somerset County, N.J.", dated 3/01/06 and prepared by Schoor DePalma; thence,

5. Along said lot line, South 42 degrees 47 minutes 56 seconds East, 252.35 feet to a point in the municipal boundary line dividing the Township of Berkeley Heights, Union County and the Borough of Watchung, Somerset County, and there to end.

Section 6.2.3 Interpretation of Zoning District Boundaries

Where uncertainty exists as to any of said boundaries as shown on said map, the following rules shall apply

A. Zoning District boundary lines are intended to follow the centerline of the streets, railroad right-of-way, streams, and lot or property lines as they exist on plats of record at the time of the passage of this Ordinance, unless such Zoning District boundary lines are fixed by dimensions as shown on the Zoning District Map.

B. Where such boundaries are not fixed by dimensions, and where they approximately follow lot lines, and where they do not scale more than ten (10) feet distance therefrom, such lot lines shall be construed to be such boundaries unless specifically shown otherwise

C. In unsubdivided land and where a Zoning District boundary divides a lot, the location of such boundary, unless the same is indicated by dimensions shown oil the Zoning District Map, shall be determined by the use of the scale appearing thereon

D. Where a street or public way serves as the Zoning District boundary line and the street or public way is lawfully vacated, the former centerline shall be considered the Zoning District boundary line
