ARTICLE 5.5 PERMITS
Section 5.5.1 Permit required

It shall be unlawful for any person to erect, alter the physical structure or message of, or relocate any sign as defined in Article 5 4 of this ordinance without first obtaining a permit from the Zoning Officer and making payment of the fee required unless such actions are specifically exempt from this provision under Section 5.5 2 of this Ordinance.

Section 5.5.2 Signs not requiring permits

The following signs in the zoning districts specified shall be exempt from the provisions of Section 5.5.1 of this ordinance

A.Residential Zones

Signs in the residential zones are considered accessory uses and are limited to the following:

I.One non-illuminated residential nameplate not to exceed 6" by 18".

II One non-illuminated temporary real estate sign, not exceeding eight square feet in area which advertises the sale, rental, or lease of the premises upon which said sign is located Any such sign must be removed not later than five (5) days after closing of title or lease execution

III. When located on the premises of any public, charitable, or religious institution, one changeable copy sign not larger than sixteen (16) square feet in area Such signs must be not less than ten (10) feet from the right of way line of the nearest street and may not be located in any required sight triangle

IV One sign, not exceeding five (5) square feet, advertising an open house for the sale of the premises upon which the sign is located Such sign may be displayed for not more than three (3) days in any, two (2) week period

V.One sign, not exceeding five (5) square feet. advertising a garage sale on the premises on which the sign is located Such sign may not be displayed for more than two days

VI Residential community signs not larger than 15" by 24" More than one shall be permitted for each community but there shall not be more than 2 per vehicular entrance to the property

B.In all other zones

In all other zones, signs shall be considered accessory uses and shall be limited to the following

i One non-illuminated real estate sign. not exceeding twelve square feet in area, which advertises the sale, rental, or lease of the premises upon which said sign is located Any such sign must be removed not later than five (5) days after closing of title or lease execution In the Business Zone such signs must be non-portable. ii For each lawful occupant of the premises, one professional nameplate, not to exceed six (6) inches in width and eighteen (18)inches in length All such signs on a building or directory shall be of uniform size. color, style. and material iii When located on the premises of a public, charitable, or religious institution, not be less than ten (10) feet from the right of way line of the nearest street and shall not be located in any required sight triangle. iv. Temporary signs as may be approved by the Township Committee for a period not to exceed ninety (90) days.

v. Gas price signs, not exceeding one square foot in area, limited to one per nozzle. Such signs shall be mounted on the pump or canopy support structure. vi. Private property identification signs not larger than two (2) feet by three (3) feet. Such signs shall be black letters on white background with a maximum limit of 4 such signs for each acre of the parcel on which located. One such sign shall be permitted regardless of the size of the parcel. vii. Parking regulation signs in accordance with the Uniform Manual of Traffic Signs. viii. One permanent banner sign, not larger than sixty (60) square feet provided that such banner is mounted on a freestanding pole and is a flag of the United States, any individual State of the United States, or a foreign country recognized by the government of the United States. ix. Decals not exceeding one (1) square foot in area.

C. Temporary Window signs

Temporary window signs are permitted in non-residential zones and must comply with the following:

i. They are posted for a period of less than thirty (30) days in any six (6) month period. ii. Each such sign must contain a notation, in the lower right corner and visible from the outside of the window, listing the date of posting and the date to be removed. iii. The combined area of temporary and permanent window signs (including decals) cannot exceed fifty (50) percent of the total area of the window.

Section 5.5.3 Application for permit

All applications for sign permits shall be made upon forms provided by the Zoning

All applications for sign permits shall be made upon forms provided by the Zoning Officer and shall contain, or have attached, the following information.

1. Date of application

2 Name, address, and telephone number of applicant

3 Location (by Lot and Block number and street address) of building, structure or lot to which, or upon which the sign is to be erected or attached.

4 Diagram or plot plan showing position of the sign on the lot and distances to all building, structures, sidewalks, or driveways on site and to all adjoining streets

5 Name of person, firm or association erecting the sign

6 Written consent of the owner of the building. structure or land to which, or upon which, the sign is to be attached or erected

7 An illustration of the sign and its contents including dimensions and area

Section 5.5 4 Permit Fees

Every application for a sign permit shall be accompanied by an application fee payable to the Township of Berkeley Heights in the amount of Ten ($10) dollars No separate fee shall be required if an application for a sign permit is filed simultaneously with, and is related to, any application for preliminary or final subdivision or site plan review filed with the Planning Board or Zoning Board of Adjustment
