20-13 R-4 RESIDENTIAL DISTRICT.
20-13.1 Principal Uses and Buildings Permitted.

In the R-4 district, the following principal uses shall be permitted:

a. Single family dwellings.

b. Townhouses.

c. Garden apartments.

d. Churches and other places of worship.

e. Public schools and parochial schools.

f. Municipal and community center buildings and grounds.

g. Municipal or county libraries, museums or art galleries.

h. Parks and playgrounds.

1. Senior citizen apartments. Restricted to low and moderate income persons.

20-13.2 Permitted Accessory Uses.

In the R-4 district, the following accessory uses shall be permitted:

a. Accessory uses and accessory buildings incidental to the above principal uses and located on the same lot, providing all other appropriate accessory setback requirements have been met and further provided the following specific restrictions are met:

1. Only fences, retaining walls, sidewalks, walkways, driveways, light posts, mail boxes, ornamental planters and the like shall be permitted in the front yard area;

2. Only fences, retaining walls, walkways, driveways, patios, sheds and the like shall be permitted in the side yard area; and

3. Only fences, retaining walls, walkways, driveways, light posts, children's play apparatus, swimming pools, patios and the like shall be permitted in the rear yard area.

b. Private garages, used for the storage of vehicles owned by residents of the premises on which they are situated, provided that vehicles not in excess of two tons net weight are stored therein.

20-13.3 Permitted Conditional Uses. None.

20-13.4 Bulk and Area Regulations.

13.4.1 Minimum Lot Area:



The following shall be the standards for uses in 20-13.1a and d through h in the R-4 district:

13.4.2 Minimum Lot Width:

a. Single family dwelling: 85 feet.

b. Churches, schools (as in 20-13.4.1b above): 100 feet.

c. Public recreational and community center (as in 20-13.4.1c above): 200 feet.

13.4.3 Minimum Yards - Principal Structures:

a. Front yard: 35 feet.

b. Rear yard: 30 feet.

c. Side yard: 9 feet/20 feet combined total.*

13.4.4 Minimum Yards - Accessory Structures:

a. Front yard: 35 feet.

b. Rear yard: 7 feet.

c. Side yard: 7 feet.

13.4.5 Maximum FAR:

a. Residential structures: .20

b. Non-residential structures: .25

13.4.6 Maximum Building Height: 25 feet.

20-13.5 Bulk, Area and Site Design Regulations Townhouse Dwellings.

The following standards apply to townhouse dwellings in the R-4 district:

13.5.1 Minimum Tract Area: 5 acres.

13.5.2 Minimum Tract Frontage: 300 feet.

13.5.3 Minimum Yards - Primary Structures:

a. Front yard: 25 feet.

b. Rear yard: 25 feet.

13.5.4 Minimum Distance Between Primary Structures: 50 feet.

13.5.5 Maximum Structure Length: 180 feet.



13.5.6 Maximum Townhouses Per Structure: 10.

13.5.7 Setback Facade Requirement:

For every 2 townhouses, the setback difference shall be no less than 4 feet. The appearance of the fronts shall vary by varying the dwelling widths, exterior material on the sides and by changing the roof line.

*For principal buildings existing prior to October, 1973 on lots now deemed to be undersized in width at the building line, the two side yards shall total 15 feet.

13.5.8 Maximum Building Coverage: 20%.

13.5.9 Maximum Gross Density: 7 dwelling units per acre.

13.5.10 Maximum Building Height: 25 feet.

13.5.11 Landscaping and Recreation:

At least 50 percent of the parcel area shall consist of landscaped open space. At least ten percent of the parcel area which can be included as part of the foregoing 50 percent shall be developed for active or passive recreation use of the residents of the development to include such facilities as play areas, sitting areas, tennis courts, and swimming pools. A minimum of two trees and four shrubs shall be planted on each townhouse yard area, exclusive of planting for buffer strips or parking lots.

13.5.12 Buffer Strips:

There shall be a buffer strip on all parcel lines, excepting public street lines, adjoining another zone at least 30 feet in width. Such buffer shall be increased to 50 feet in width in those instances where the parcel line abuts an existing single-family use or a residential zone of a lesser density. The buffer, if wooded, shall remain in the natural state, or if not substantially wooded, shall be landscaped with a visual screen, at least four feet in height at the time of planting. The planting shall be in double alternate rows in a strip at least 12 feet wide.

13.5.13 Access Drives or Roadways:

Access drives shall be at least 24 feet wide, curbed with concrete or Belgian block and at least 20 feet from any principal use structure. All other roadways shall be built to town specifications currently in force and dedicated to the town for public use.

13.5.14 Lighting:

Noncorrosive ornamental lighting shall be provided and shielded to direct illumination downward for walks, steps, and parking areas and roadways to insure safe and convenient nighttime use.

13.5.15 Access for Emergency Vehicles:

At least two avenues of access shall be provided for each parcel; the parcel shall be so designed that all emergency vehicles have access to each townhouse.

13.5.16 Utilities:

Water and sewer service shall be provided in compliance with the rules and regulations of the water and sewer department and existing codes. All utilities and their service lines, including but not limited to, water, sewer, gas, electric, telephone and TV cable, shall be installed underground in accordance with the specifications of the appropriate utilities. Whenever a utility is not installed in a public right-of-way, an appropriate utility easement shall be provided.

13.5.17 Size of Units:

There shall be a mixture of different size townhouse units with different numbers of bedrooms to the satisfaction of the planning board to ensure that the needs of the community are being met and to further ensure maximum stability of the association which will hold title to certain common lands.

13.5.18 Snow and Trash Removal:

Adequate facilities as determined by the planning board shall be provided for the collection and removal of snow from the common areas, and trash and garbage from the parcel at no expense to the town.

13.5.19 Television Antenna:

A master TV antenna or cable television shall be provided with no individual television antennas or satellite dishes allowed on the roof or exterior of the buildings.

13.5.20 Means of Egress:

Both front and rear exits to the outside at or near ground level from each individual townhouse unit shall be provided.

13.5.21 Individual Controls: Each unit shall be provided with individual heat and air conditioning controls.

13.5.22 Other Requirements:

Other reasonable standards and conditions not inconsistent with the intent of this section may be imposed by the planning board at the time of review of the plans which shall be approved prior to the issuance of a building permit.

13.5.23 Approval Procedures:

The applicant shall apply for approval of a site plan of the project.

13.5.24 Filing Fees:

At the time of filing an application for approval, the applicant shall pay the filing fee as set forth in the Town's Fee Ordinance.

13.5.25 Additional Fees:

In addition, the developer shall pay inspection fees as set forth in the Town's Fee ordinance.

13.5.26 Common Open Space Ownership and Maintenance:

The applicant shall provide for and establish an organization for the ownership and maintenance of all common open space as stipulated in subsection 20-5.10.

20-13.6 Bulk, Area and Site Design Regulations-Garden Apartments.

The following standards shall apply to garden apartments in the R-4 district:

13.6.1 Minimum Tract Area: 2 acres.

13.6.2 Minimum Tract Frontage: 150 feet.

13.6.3 Minimum Distance of Primary Structures to Property Line:

Front property line: 50 feet.

Rear property line: 75 feet.

Side property line: 25 feet.

13.6.4 Minimum Distance Between Primary Structures: 50 feet.

13.6.5 Maximum Gross Density: 12 units per acre.

13.6.6 Maximum Building Coverage: 20%.

13.6.7 Maximum Dwelling Units Per Building: 16.

13.6.8 Maximum Building Length: 200 feet.

13.6.9 Maximum Dwelling Units Served Per Common Entrance: 2.

13.6.10 Maximum Building Height: 35 feet.

13.6.11 Minimum Recreation/Open Space Requirements: 15%.

The 15% of gross site area available for recreation and open space shall exclude buildings, structures, driveways and parking areas. All open space, not covered by buildings and paved areas, shall be graded as lawn and landscaped in accordance with a site plan approved by the planning board. All recreation areas and swimming pools on this tract shall be as far as possible from adjoining residential properties.

13.6.12 Minimum Width of Interior Access Roads: 20 feet.

Interior access roads shall be paved and be at least 20 feet in width. There shall be a minimum of two means of access to the site from a public street or public streets. As an alternative, the interior roadway shall form a loop connecting a single access to a public street in which case the access road shall be paved to a width of 30 feet at the entrance.

13.6.13 Minimum Recreation Facilities:

A fenced play area with swings, slides and similar play equipment shall be provided adjacent to each garden apartment building.

13.6.14 Curbing/Sidewalk Requirements:

A concrete sidewalk from each building entrance leading to the parking area shall be required. Concrete curbs shall separate all grass and paved areas, and concrete sidewalk and concrete curbs shall be erected along all public street frontage.

13.6.15 Water and Sewer Service:

Water and sewer service shall be installed in full compliance with the rules and regulations of the water and sewer department and the town plumbing code. Plans shall include an underground compartment to house a master water meter if required.

13.6.16 Maximum Distance From Fire Hydrant:

A fire hydrant serviced by a minimum 8 inch water main shall be located within 600 feet of the farthest point of every apartment building proposed to be erected. Unless presently existing, such fire hydrant shall be installed by the garden apartment owner.

13.6.17 Ownership and Maintenance of Open Space:

Any common open space on a lot shall conform to ownership and maintenance requirements as stipulated in subsection 20-5.10.
