13-7.2902 Required Conditions.

A. Principal Permitted Uses

1. Business and professional offices.

2. Research and engineering offices and labs.

3. Warehouses including mini-warehousing/self-storage.

4. Manufacturing, fabrication, assembly and processing operations.

5. Child care centers as governed by C.40:55D-66.6 of the Municipal Land Use Law.

6. Essential services.

B. Accessory Uses.

1. Off-street parking.

2. Fences.

3. Signs subject to the provisions of Section 13-8.9.

4. Retail sales which are an accessory use and clearly incidental to the principal permitted use occurring on the property.

5. Outdoor bulk storage subject to the provisions of Section 13-7.816.

6. Customary accessory uses and buildings which are clearly incidental to the principal use and building.

C. Conditional Uses



1. Institutional uses.

D. Area, Yard and Building Requirements



1. Minimum lot area: 43,560 square feet.

2. Minimum lot width at setback: 200 feet.

3. Minimum lot frontage: 200 feet.

4. Minimum front yard setback: 50 feet.

5. Minimum rear yard setback for principal and accessory buildings shall be no less than 40 feet; however, where a railroad right-of-way or power line easement abuts the rear of the property, the area within the right-of way or easement may be considered part of the rear yard but in no case shall the rear yard setback be reduced to less than 25 feet.

6. Minimum side yard setback for principal and accessory building shall be no less than 30 feet; however, where a railroad right-of-way or power line easement abuts the side yard, the area within the right-of-way or easement may be considered part of the side yard but in no case shall the rear yard setback be reduced to less than 25 feet.

7. Maximum building height: three stories and not more than 42 feet.

8. Maximum floor area ratio: .25

9. Maximum impervious coverage: 55 percent.

10. Parking coverage and setbacks:

a. No more than 35 percent of the front yard area shall be used for off-street parking, including access aisles and driveways.

b. Parking, including access aisles and driveways, shall be located no closer than 25 feet to any adjoining street right-of-way line.

c. Parking, including access aisles and driveways, shall be located no closer than 10 feet to any property line or building.

13-7.30 I-3 LIMITED INDUSTRIAL DISTRICT.



13-7.3001 Purpose

This district is designed for industrial uses, business and professional offices, and limited retail sales incidental to the principal uses.

13-7.3002 Required Conditions.

A. Principal Permitted Uses

1. All principal permitted uses allowed in the I-1 Limited Industrial District.

2. Lumber yards.

3. Wholesale building material supply yards, yards of contractors in the construction and building trades and similar operations requiring bulk storage of materials and equipment, such as building construction supplies and the equipment, vehicles and supplies of heavy equipment contractors subject to bulk storage provisions of Section 13-7.816.

B. Accessory Uses.

1. All accessory uses allowed in the I-1 Limited Industrial District.

C. Conditional Uses

1. Institutional uses.

2. Wholesale/discount self-service store centers containing a minimum floor area of 75,000 square feet and no more than three stores, provided that the property abuts a business zone permitting retail uses.

D. Area, Yard and Building Requirements

1. Minimum lot area: 3 acres.

2. Minimum lot width at setback: 300 feet.

3. Minimum lot frontage: 300 feet.

4. Minimum front yard setback: 100 feet.

5. Minimum rear yard setback for principal and accessory buildings shall be no less than 50 feet; however, where a railroad right-of-way or power line easement abuts the rear of the property, the area within the right-of way or easement may be considered part of the rear yard but in no case shall the rear yard setback be reduced to less than 25 feet.

6. Minimum side yard setback for principal and accessory buildings shall be no less than 50 feet; however, where a railroad right-of-way or power line easement abuts the side yard, the area within the right-of-way or easement may be considered part of the side yard but in no case shall the rear yard setback be reduced to less than 25 feet.

7. Maximum building height: four stories and not more than 48 feet.

8. Maximum floor area ratio: .25.

9. Maximum impervious coverage: 55 percent.

10. Parking coverage and setbacks: a) No more than 25 percent of the front yard area shall be used for off-street parking, including access aisles and driveways. b) Parking, including access aisles, shall be located no closer than 60 feet to any adjoining street right-of-way line or 20 feet to any property line within the front yard. c) Parking, including access aisles and driveways, shall be located no closer than 10 feet to any side or rear property line and no closer than 15 feet to any building. d) Parking, including access aisles and driveways, shall be located no closer than 20 feet to any adjacent residence district boundary line.

11. District boundary line restrictions: No building shall be built within 100 feet of any residence district boundary line; however, where a railroad right-of-way or power line easement abuts a residential district boundary line, the area within the right-of-way or easement may be considered in calculating the 100-foot district boundary line restriction but in no case shall the building setback from the property line be reduced to less than 50 feet.

13-7.31 I-5 LIMITED INDUSTRIAL DISTRICT.

13-7.3101 Purpose

This district is designed for industrial uses, business and professional offices, and limited retail sales incidental to the principal use.

13-7.3102 Required Conditions.

A. Principal Permitted Uses

1. All principal permitted uses allowed in the 1-3 Limited Industrial District..

B. Accessory Uses.



1. All accessory uses allowed in the 1-3 Limited Industrial District.

C. Conditional Uses

1. All conditional uses allowed in the 1-3 Limited Industrial District.

2. Motor vehicle sale establishments.

3. Wireless telecommunications technology.

D. Area, Yard and Building Requirements



1. Minimum lot area: 5 acres.

2. Minimum lot width at setback: 400 feet.

3. Minimum lot frontage: 400 feet.

4. Minimum front yard setback: 150 feet.

5. Minimum rear yard setback for principal and accessory buildings shall be no less than 75 feet; however, where a railroad right-of-way or power line easement abuts the rear of the property, the area within the right-of way or easement may be considered part of the rear yard but in no case shall the rear yard setback be reduced to less than 25 feet.

6. Minimum side yard setback for principal and accessory buildings shall be no less than 75 feet; however, where a railroad right-of-way or power line easement abuts the side yard, the area within the right-of-way or easement may be considered part of the side yard but in no case shall the rear yard setback be reduced to less than 25 feet.

11. District boundary line restrictions: No building shall be built within 150 feet of any residence district boundary line; however, where a railroad right-of-way or power line easement abuts a residential district boundary line, the area within the right-of-way or easement may be considered in calculating the 150 foot district boundary line restriction but in no case shall the building setback from the property line be reduced to less than 50 feet.

13-7.3103 Lot Averaging

Lot averaging is permitted in the 1-5 District subject to the following requirements.

A. General Requirements. In addition to the requirements set down below, use of the lot averaging option must meet the provisions of Section 13-7.828 "Lot Averaging in Office Research and Industrial Districts."

B. Minimum Lot Size. There shall be an average minimum lot area of 217,800 square feet measured within 545 feet of the front street right-of-way line. The minimum lot size may be reduced but in no case shall it be reduced below 108,900 square feet.

C. Maximum FAR. The total gross floor area of all buildings on any lot of the planned development shall not exceed 25 percent of the total lot area.

D. Maximum Impervious Coverage. The maximum impervious coverage for any lot of the planned development shall not exceed 50 percent of the total lot.

E. Minimum Front Yard. There shall be a front yard of not less than 150 feet for all buildings fronting on a public road and not less than 75 feet for all buildings fronting on an internal access road to a planned industrial development.

F. Minimum Side Yard. There shall be two side yards and for lots of 5 acres or more, each side yard shall not be less than 75 feet. For lots of under 5 acres, the side yards may be reduced to not less than 25 feet. Any side yard abutting a residential use shall not be less than 75 feet. Where a railroad right-of-way or power line easement abuts the side yard, the area within the right-of-way or easement may be considered as part of the side yard but in no case shall the side yard be reduced to less than 25 feet.

G. Minimum Rear Yard. There shall be a rear yard of not less than 75 feet for lots of 5 acres or more. For lots under 5 acres, the minimum rear yard shall not be less than 25 feet unless the rear yard abuts a residential use, in which case the rear yard may not be less than 75 feet. Where a railroad right-of way or a power line easement abuts the rear yard, the area within the right-of way or easement may be considered as part of the rear yard but in no case shall the rear yard be reduced to less than 25 feet.

H. District Boundary Line Restrictions. In accordance with Section 137.3002D. 1 1 shall be observed.

1. Distance Between Buildings. No structure, no addition thereto nor any structure accessory thereto shall be erected closer to another such structure than 50 feet or one and one half the height of the taller structure, whichever is greater.

J. Buffer. A minimum buffer of 50 feet shall be provided where industrial or office uses abut a residential use or district. This buffer shall be required in addition to the setback and shall be attractively planted with trees, shrubs, plants and grass necessary to provide a visual buffer from adjacent residential uses or districts. Parking shall not be permitted in any required buffer area.

13-7.32 1-10 LIMITED INDUSTRIAL DISTRICT.

This district is designed for industrial uses, business and professional offices, and limited retail sales incidental to the principal use.
