ORDINANCE No. 2002 - 25 AMENDING THE OFFICIAL ZONING MAP

AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE TOWNSHIP OF MARLBORO, AND AMENDING AND SUPPLEMENTING CHAPTER 84, "LAND USE DEVELOPMENT AND REGULATIONS", OF THE "CODE OF THE TOWNSHIP OF MARLBORO, NEW JERSEY".

BE IT ORDAINED by the Township Council of the Township of Marlboro, County of Monmouth, and State of New Jersey as follows:

1. That the Official Zoning Map of the Township of Marlboro is hereby amended in order to delete certain real property known and designated as Block 360, Lot 26 on the Marlboro Township Tax Map, and more specifically described in a legal description attached hereto as Exhibit "A"and incorporated herein, from the "LI Light Industrial Zone District" and to include said property, in the "R-20AH-1 Residential District".

2. That the Official Zoning Map of the Township of Marlboro is hereby amended in order to delete a portion of certain real property known and designated as Block 360, Lot 5.01 on the Marlboro Township Tax Map, and more specifically described in a legal description attached hereto as Exhibit "B" and incorporated herein, from the "LI Light Industrial Zone District" and to include said property in the "R-20AH-1 Residential District".

3. That Sub-section 84-29B, entitled "Zoning Map", of Section 84-29, "Districts; map and boundaries; schedule of requirements", of Chapter 84, "Land Use Development and Regulations", of the "Code of the Township of Marlboro, New Jersey", is hereby amended and supplemented so that it shall now reference that an amendment to the Official Zoning Map of the Township of Marlboro has been effectuated with the adoption of this Ordinance.

4. That all other Ordinances or parts of Ordinances inconsistent herewith are hereby repealed to the extent of such inconsistencies.

5. That, in the event that any portion of this Ordinance is found to be invalid for any reason by any court of competent jurisdiction, such judgment shall be limited in its effect only to that portion of the Ordinance actually adjudged to be invalid, and the remaining portions of this Ordinance shall be deemed severable therefrom and shall not be affected.

6. That this Ordinance shall take effect upon final passage and publication in accordance with the law.
