ORDINANCE NO. 2000-3

AMENDING AND SUPPLEMENTING SECTION 84-29B ENTITLED "ZONING MAP,"

AN ORDINANCE AMENDING AND SUPPLEMENTING SECTION 84-29B ENTITLED "ZONING MAP," OF CHAPTER 84 ENTITLED "LAND USE DEVELOPMENT AND REGULATIONS" OF THE "CODE OF THE TOWNSHIP OF MARLBORO, NEW JERSEY." TO REZONE CERTAIN LOTS TO THE R-60 RESIDENTIAL DISTRICT."

BE IT ORDAINED by Mayor and Council of the Township of Marlboro, County of Monmouth, State of New Jersey, that the following provisions of the Marlboro Code shall be amended and supplemented as follows:

1. That Subsection 84-29B be amended and supplemented to the effect that the zoning map adopted by said subsection shall be revised so as to:

Delete the premises designated as Block 148, Lots 1, 3, 31, and 31.01 and Block 149, Lot 16 from the MFD-II Multifamily District and so as to include said tax lots in the R-60 Residential District

AN ORDINANCE AMENDING AND SUPPLEMENTING SECTION 84-29B ENTITLED ZONING MAP" OF CHAPTER 84 ENTITLED LAND USE DEVELOPMENT AND REGULATIONS" OF THE CODE OF THE TOWNSHIP OF MARLBORO, NEW JERSEY TO REZONE CERTAIN LOTS TO THE C 2 RESIDENTIAL DISTRICT

BE IT ORDAINED by Mayor and Council of the Township of Marlboro, County of Monmouth, State of New Jersey. that the following provisions of the Marlboro Code shall be amended and supplemented as follows:

1. That Subsection 84-29B be amended and supplemented to the effect that the zoning map adopted by said subsection shall be revised so as to:



Delete the premises designated as Block 150, Lots 2. 3. 4, and 9 and Block 151. Lot 4 from the MFD-II Multifamily District and so as to include said tax lots in the C-2 Neighborhood Commercial District

AN ORDINANCE AMENDING AND SUPPLEMENTING SECTION 84-29B ENTITLED "ZONING MAP". OF CHAPTER 84 ENTITLED LAND USE DEVELOPMENT AND REGULATIONS" OF THE CODE "CODE OF THE TOWNSHIP OF MARLBORO, NEW JERSEY", TO REZONE CERTAIN LOTS TO RSCS SENIOR CITIZEN RESIDENTIAL AND SINGLE FAMILY DISTRICT".

BE IT ORDAINED by the Mayor and Council of the Township of Marlboro. County of Monmouth, State of New Jersey. that the following provisions of the Marlboro Code shall be amended and supplemented as follows:

1. That Subsection 84-29B be amended and supplemented to the effect that the zoning map adopted by said subsection shall be revised so as to Delete the premises designated as Block 101, Lots 1 through 17 from LC Land Conservation District and so as to include said tax lots in RSCS Senior Citizen Residential and Single Family District

AN ORDINANCE OF THE TOWNSHIP OF MARLBORO, NEW JERSEY, AMENDING AND SUPPLEMENTING ORDINANCE NO. 2000-3, ADOPTED ON MARCH 9, 2000 AND ENTITLED "AN ORDINANCE AMENDING AND SUPPLEMENTING SECTION 84-29B ENTITLED "ZONING MAP," OF CHAPTER 84 ENTITLED LAND USE DEVELOPMENT AND REGULATIONS OF THE CODE OF THE TOWNSHIP OF MARLBORO, NEW JERSEY TO REZONE CERTAIN LOTS TO THE R-60 RESIDENTIAL DISTRICT."

BE IT ORDAINED by the Township Council of the Township of Marlboro, in the County of Monmouth and State of New Jersey. as follows:

1, That Ordinance No. 2000-3, adopted on March 9, 2000 and entitled, An Ordinance Amending and Supplementing Section 84-29B Entitled zoning Map, of Chapter 84 Entitled Land Use Development and Regulations of the Code of the Township of Marlboro, New Jersey to Rezone, Certain Lots to the R-60 Residential District, - is hereby amended and supplemented in order to add an additional Paragraph, to be known as Paragraph 4 thereof, as follows (additions are shown with underline):

4 Notwithstanding the provisions of the paragraph, this Ordinance shall not take effect until approval has been received from the Superior Court of New Jersey or the Council on Affordable Housing (COAH) authorizing its implementation.

ORDINANCE NO. 2002-16

AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE TOWNSHIP OF MARLBORO, NEW JERSEY, IN ORDER TO REALIGN CERTAIN ZONING DISTRICTS ADJACENT TO NEW JERSEY STATE HIGHWAY 79

WHEREAS, the Township of Marlboro wishes to amend the Official Zoning Map of the Township in order to realign certain zoning districts adjacent to New Jersey State Highway 79, in the vicinity of Harnley Road, so that said designation shall be more consistent with the character of the area; and

WHEREAS, the proposed amendments are consistent with recommendations made by the Planning Board in its most recent revisions to the Township's Master Plan.

NOW, THEREFORE, BE AND IT IS HEREBY ORDAINED by the Township Council of the Township of Marlboro, in the County of Monmouth and State of New Jersey, as follows:

1. That the Official Zoning Map of the Township of Marlboro is hereby amended in order to realign the boundaries of the "CS Commercial Service District" and the "SCMFD-1 Senior Citizen Multifamily District-I", located adjacent to New Jersey State Highway 79 in the vicinity of Harnley Road, in accordance with the provisions set forth herein. Specifically, the Official Zoning Map is hereby amended in the following respects:

a. The zoning designation of a portion of the property known and designated as Block 132, Lot 13 on the Marlboro Township Tax Map, as more particularly described in a legal description prepared by Crest Engineering Associates, Inc. and dated May 23, 2002, a copy of which is attached hereto as Schedule "A" and made a part hereof, is hereby changed from the "CS Commercial Service District" to the "SCMFD-1 Senior Citizen Multifamily District-I". The area in question is depicted in more detail on a Map, also prepared by Crest Engineering Associates, Inc. and dated September 27, 2001, as last revised April 24, 2002, a copy of which is available for public inspection and review in the Office of the Municipal Clerk.

b. The zoning designation of a portion of the property known and designated as Block 132, Lot 14 on the Marlboro Township Tax Map, as more particularly described in a legal description prepared by Crest Engineering Associates, Inc. and dated May 23, 2002, a copy of which is attached hereto as Schedule "B" and made a part hereof, is hereby changed from the "SCMFD-1 Senior Citizen Multifamily District-[" to the "CS Commercial Service District". The area in question is depicted in more detail on a Map, also prepared by Crest Engineering Associates, Inc. and dated September 27, 2001, as last revised April 24, 2002, a copy of which is available for public inspection and review in the Office of the Municipal Clerk.

2. That all other Ordinances or parts of Ordinances inconsistent herewith are hereby repealed.

3. That, in the event that any portion of this Ordinance is found to be invalid for any reason by any court of competent jurisdiction, such judgment shall be limited in its effect only to that portion of the Ordinance actually adjudged to be invalid, and the remaining portions of this Ordinance shall be deemed severable therefrom and shall not be affected.

4. That this Ordinance shall take effect upon final passage and publication in accordance with the law.
