DIVISION 29. EXCEPTIONS TO HEIGHT LIMITS AND AREA REQUIREMENTS

Sec. 62-2341. Exceptions to height limits.

Penthouses or roof structures for the housing of elevators, stairways, tanks, ventilating fans, air conditioning equipment or similar equipment required to operate and maintain the building; parapet walls; skylights; towers; spires; steeples; flagpoles; chimneys; smokestacks; radio and television towers; monuments; water tanks; silos or similar structures may be erected above the height limits prescribed by this chapter, provided that such features shall not exceed 20 percent of the total roof area of the principal building. Sec. 62-2342. Exceptions to general area requirements.

Any lot recorded subsequent to the passage of the ordinance from which this chapter is derived which fails to comply with the minimum depth and/or area requirements of this chapter due to dedication or conveyance to the township to meet the minimum street width requirement of this chapter or to implement the official map or master plan of the township may be used for any use not otherwise prohibited in the district in which it lies, provided that the lot is in single ownership and would have conformed except for the dedication or conveyance. Whenever title to two or more contiguous lots is held by the same ownership and one or more of such individual lots should not conform with the minimum area and dimensional requirements for the district in which it is located by reason of exceptional narrowness, shallowness or topographic conditions, such lots shall be considered as a single lot for the purposes of this chapter.
