ARTICLE III Plat Details
§ 214-13. Submission of application.

Any owner of land within the Township of Nutley shall, prior to subdividing or resubdividing land, as defined in this chapter, submit an application for subdivision approval to the Township Clerk upon a form to be provided by the, Board, accompanied by such appropriate map of the proposed subdivision in number required by this Article. The Township Clerk shall transmit such application and map to the Chairman of the Board within three (3) days. A copy shall also be submitted to the Construction Official.

§ 214-14. Forms.



The Board shall provide two (2) types of application forms, one (1) for minor subdivisions and one (1) for major subdivision.

§ 214-15. Minor subdivision requirements.

A. Application for approval of a minor subdivision shall provide eighteen (18) copies on the appropriate form provided and shall be accompanied by eighteen (18) copies of a plat of the proposed subdivision, including the original drawing on tracing cloth or Mylar. The plat shall set forth the data required in Subsection E of this section.

B. The Subdivision Committee shall consider and act upon each application for a minor subdivision within forty-five (45) days after receiving it. If the Subdivision Committee unanimously finds that the application is complete and that it conforms to the definition of a "minor subdivision" as contained in this chapter, and if it meets with the Committee's unanimous approval, the Subdivision Committee is hereby empowered to waive the requirements for notice, hearings and review by the Planning Board and any other requirements except those provided for in this section. Such findings shall be deemed to be favorable approval by the Planning Board. Upon such approval, the Chairman of the Subdivision Committee shall make a signed notation to that effect upon the original plat and shall forward it to the Chairman of the Planning Board for signature. Such Chairman shall forthwith forward it to the Township Clerk for signature. Such signed plat shall be returned by the Township Clerk to the subdivider following its approval by the Subdivision Committee, County Planning Board and other signatories in accordance with the Map Filing Law, provided that payment has been made for the reproductions. No further Planning Board approval shall be required.

C. A report of the action of the Subdivision Committee on each minor subdivision application shall be made at the next regular meeting of the Planning Board following such action and shall be noted upon the minutes of said Board's meeting.

D. Any plat not classified as a minor subdivision by unanimous action of the Subdivision Committee shall be referred to the full Board. A notation of the Board's action shall be made on the plat by the Chairman of the Subdivision Committee. The plat shall then be returned to the Town Clerk by the Chairman of the Subdivision Committee with instructions to forward the same to the subdivider for compliance with the procedures for a major subdivision.

E. Plat details for minor subdivisions.

(1) Plats for minor subdivisions shall be prepared pursuant to N.J.S.A. 46:23-9.1 et seq. (New Jersey Map Filing Law).

(2) The plat shall be clearly drawn and legibly lettered on tracing cloth or Mylar at a scale of not smaller than one (1) inch equals (50) feet. It shall be certified to be accurate by a land surveyor licensed to practice as such in New Jersey; and in addition to the requirements of N.J.S.A. 46:23-9.1 through 46:23-9.8, it shall show or include the following information:



(a) The location of that portion which is to be subdivided in relation to the entire tract.

(b) All existing structures standing upon or within two hundred (200) feet of the portion to be subdivided.

(c) The name of the owner of the land being subdivided and the names of the owners of all adjoining properties as the same appear in the most recent town tax records.

(d) The Township Tax Assessment Map block and lot numbers.

(e) All streets or roads and streams within one hundred (100) feet of the subdivision.

(f) The location of any existing driveways and parking areas.

(3) Eighteen (18) copies of the plat shall be provided.

§ 214-16. Major subdivision requirements.

A. Plat details for preliminary plats for major subdivisions.

(1) Plats for preliminary major subdivisions shall be prepared pursuant to N.J.S.A. 46:23-9.1 et seq. (New Jersey Map Filing Law).

(2) The preliminary plat shall be clearly drawn and legibly lettered on tracing cloth or Mylar at a scale of not smaller than one (1) inch equals one hundred (100) feet. Eighteen (18) copies of the preliminary plat shall be submitted. All preliminary plats shall be designed and drawn by a professional engineer or land surveyor licensed to practice as such in New Jersey. The plat shall give or show the following information:

(a) A key map at one-fourth scale of the plat, showing the subdivision, zoning designation and the surrounding area to a depth of four hundred (400) feet from the boundary of the subdivision.

(b) The tract name, Tax Assessment Map block and lot numbers, date of drawing, reference meridian, graphic scale and the names and addresses of:

[1] The record owner or owners.

[2] The owner's agent, if any.

[3] The person who prepared the map.

(c) The acreage of the tract to be subdivided, calculated to the nearest one-tenth (1/10) of an acre.

(d) Contours at five-foot intervals for slopes averaging ten percent (10%) or greater and at two-foot intervals for lesser slopes.

(e) The location of existing and proposed property lines, streets, utilities, buildings, watercourses, railroads, bridges, culverts and drainpipes and any natural features, such as wooded areas, rock formations, etc., and the location of any existing driveways and parking areas, all within two hundred (200) feet of the proposed subdivision.

(f) Plans of proposed utility layouts (sewers, storm drains and water, gas and electrical facilities), showing feasible connections to existing or any proposed utility systems.

(g) The location, width and purpose of any easements or rights-of-way, existing or proposed.

(h) The building envelope for each lot showing how a building meeting all setback requirements could be placed on the lot.

(3) In addition, the following shall be provided with each application for preliminary subdivision approval:

(a) A copy of any protective covenants or deed restrictions applying to the land being subdivided.

(b) Proof that no taxes or assessments are due or delinquent on the property proposed for subdivision.

(c) In the case of a subdivision by a corporation or partnership, the names and addresses of all stock- holders or individual partners owning at least ten- percent interest shall be provided in accordance with N.J.S.A. 40:55D-48.2.

B. Plat details for final subdivision approval.

The final plat shall be drawn in ink on tracing cloth or Mylar at a scale of not smaller than one (1) inch equals fifty (50) feet and in compliance with all the provisions of N.J.S.A. 46:23-9.1 through 46:23-9.8. Eighteen (18) copies of the final plat shall be submitted. The final plat shall show or he accompanied by the following:

(1) The date, name and location of the subdivision, name of the owner, graphic scale, reference meridian and zoning designation.

(2) Tract boundary lines, right-of-way lines of streets, street names, easements and other rights-of-way, all lot lines and other site lines, with accurate dimensions, bearings of deflection angles and radii, arcs and central angles of all curves.

(3) The purpose of any easement shall be designated, and the proposed use of sites other than residential shall be noted.

(4) Each block shall be numbered serially, beginning with number 1.

(5) The minimum building setback line on all lots and other sites.

(6) The names of owners of adjoining unsubdivided land.

(7) The location and a description of all monuments.

(8) A certification by a licensed engineer and land surveyor as to accuracy of details of the plat.

(9) A certification that the applicant is the owner of the land to be subdivided.

(10) Cross sections at twenty-five-foot intervals and profiles of streets, approved by the Town Engineer, shall accompany the final plat.

(11) Contours at five-foot intervals for slopes averaging ten percent (100/0) or greater and at two-foot intervals for lesser slopes.

(12) Plans and profiles of storm sewers and sanitary sewers and plans of water mains.

(13) A certificate from the Tax Collector that all municipal real property taxes on the lands to be subdivided have been paid to date.
