AN ORDINANCE OF THE TOWNSHIP OF MAHWAH AUTHORIZING THE SALE OF LOT 4.01 IN BLOCK 130, A VACANT UNDERSIZED PARCEL OF LAND LOCATED ON MOUNTAINSIDE AVENUE PURSUANT TO THE LOCAL LANDS AND BUILDINGS LAW

WHEREAS, Lot 4.01 in Block 130 is vacant land located on Mountainside Avenue and is less than a minimum size required for development under the Municipal Zoning Ordinance and does not contain any capital improvement thereon; and

WHEREAS, the Assessor has determined that the fair market value of the property is not greater than $10,000; and

WHEREAS, N.J.S.A. 40A:12-13(b)(5) permits the sale of Lot 4.01 in Block 130 to the highest bidder from among the contiguous property owners; and

WHEREAS, the Township has received an inquiry from a real estate professional for the purchase of Lot 4.01 in Block 130 in the amount of $15,000.00; and

WHEREAS, the Township Council has determined that Lot 4.01 in Block 130 is no longer required for public purpose:

NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township of Mahwah as follows:

1. Lot 4.01 in Block 130 be offered for sale to the highest bidder among the contiguous property owners, with a minimum bid of $15,000.00;

2. The sale shall be accomplished pursuant to the requirements of the Local Lands and Buildings Law and specifically N.J. S.A. 40A:12-13(b)(5);

3. The deed to the successful bidder shall contain a restrictive covenant which will require the property to be used only in conjunction with a contiguous property and existing structure and prohibit any use of the property to create a newly subdivided lot.

BE IT FURTHER ORDAINED that the Mayor, Clerk and Administrator are hereby authorized to execute all such documents as are necessary to effectuate the sale of Lot 4.01 in Block 130 for a minimum bid of $15,000.00; and

BE IT FURTHER ORDAINED that this Ordinance shall become effective after final passage, adoption and publication as required by law.
