AN ORDINANCE TO VACATE A DRAINAGE EASEMENT ON PROPERTY KNOWN AS BLOCK 11 LOT 2.06 AND TO VACATE A DRAINAGE EASEMENT ON PROPERTY KNOWN AS BLOCK 11 LOT 2.07 AND TO ACCEPT A DRAINAGE EASEMENT ON PROPERTY KNOWN AS BLOCK 11 LOT 2.06 AND TO ACCEPT A DRAINAGE EASEMENT ON PROPERTY KNOWN AS BLOCK 11 LOT 2.07 | |||||||
BE IT ORDAINED by the Mayor and Council of the Borough of Alpine, Bergen County, New Jersey as follows: | |||||||
WHEREAS, a detention pond was located on a portion of Lot 2.06 and Lot 2.07 in Block 11 as shown on a subdivision map entitled "Final Subdivision Plat of Cresskill Hills" prepared by Boswell Engineering, dated June 30, 2000 filed in the Bergen County Clerk's Office on August 1, 2001 as Map No. 9238; and | |||||||
WHEREAS, the owner of Lot 2.06 and Lot 2.07, Tamcrest Estates, L.L.C. has reconfigured a detention basin for which the drainage easements were obtained; and | |||||||
WHEREAS, the Borough Engineer has reviewed the plans for the reconfigured detention basin and approved same; and | |||||||
WHEREAS, in order to reconfigure the detention basin the Borough must vacate the drainage easements shown on filed Map No. 9238 and accept new drainage easements across both Lot 2.06 and Lot 2.07 in Block 11; and | |||||||
WHEREAS, the Borough Council finds that it is in the best interest of the Borough to reconfigure the detention basin; and | |||||||
WHEREAS, the New Jersey Local Lands and Buildings Law permits a municipality, by ordinance, to release an easement and to accept easements: | |||||||
NOW THEREFORE, BE IT ORDAINED by the Borough Council of the Borough of Alpine as follows: | |||||||
1. The Borough of Alpine hereby agrees to vacate the drainage easement located on a portion of Lot 2.06 and Lot 2.07 in Block 11 and shown on Subdivision Map entitled "Final Subdivision Plat of Cresskill Hills" prepared by Boswell Engineering, dated June 30, 2000 filed in the Bergen County Clerk's Office on August 1, 2001 as Map No. 9238. The description of the easements being vacated are attached as Exhibit A and Exhibit B. | |||||||
2. The Borough hereby agrees to accept the drainage easements described in Exhibits C and D annexed hereto across Lot 2.06 and Lot 2.07 in Block 11. | |||||||
3. The Mayor and Borough Clerk are authorized to execute the necessary documents required to vacate the easements and accept the new easements for the reconfiguration of the detention basin. | |||||||
BE IT FURTHER ORDAINED that this Ordinance shall take effect upon passage and publication as required by law. | |||||||
