FENCE - Any type of freestanding wall or structural enclosure, other than a wall of a building, whether of wood, metal, wire, concrete or other material

HEDGE - A group of bushes, shrubbery or other plant life so situated as to be similar in function and serve the same ends as a fence, also referred to as a "living fence "

PERSON -- Any landowner, lessor, lessee, tenant or other person in possession of lands lying within the borough

RETAINING WALL - A permanent artificial device constructed to change or preserve the finished grade of a given parcel of land, no portion of which is above finished grade on more than one side of the retaining wall

GROUND SIGN -- Any sign self-supported by uprights or braces placed upon the ground independent of any other structure

ILLUMINATING SIGN -- Any sign which has characters, letters, figures, designs or outlines illuminated by electric lights or luminous tubes as a part of the sign proper

PERSON -- Any person, firm, partnership, association, corporation, company or organization of any kind

SIGN -- Every sign, billboard, ground sign, wall sign, roof sign, sign painted on the exterior of a building or structure, illuminated sign, projecting sign, temporary sign, and sign on awnings and canopies, and shall include any announcement, declaration, demonstration, display, illustration or insignia used to advertise or promote the interests of any person, firm or corporation when the same is placed out-of-doors in view of the general public or when of a permanent nature and placed within the window of a commercial or other structure so as to be visible to persons from the outside for the purposes aforesaid

SIGN AREA -- The total area of the entire sign, including border and embellishments, but excluding supports on which there is displayed neither advertising matter nor lighting For signs which are not rectangular in shape, the area shall be calculated by the smallest trapezoidal shape, four-sided, which completely encloses the sign

TEMPORARY SIGN -- Any sign which is intended to be displayed for a short period of time not in excess of 180 days, and shall include any sign, banner, pennant, flag or advertising display constructed of cloth, canvas, light fabric, cardboard display, wallboard or other light material with or without frames

CAFRA PLANNING MAP means the geographic depiction of the boundaries for Coastal Planning Areas, CAFRA Centers, CAFRA Cores and CAFRA Nodes pursuant to N.J.A.C. 7:7E-5B.3.

CAFRA CENTERS, CORES OR NODES means those areas within boundaries accepted by the Department pursuant to N.J.A.C. 7:8E-5B.

COMPACTION means the increase in soil bulk density.

       

CORE means a pedestrian-oriented area of commercial and civic uses serving the surrounding municipality, generally including housing and access to public transportation.

COUNTY REVIEW AGENCY means an agency designated by the County Board of Chosen Freeholders to review municipal stormwater management plans and implementing ordinance(s). The county review agency may either be:

       A.county planning agency; or

       A.county water resource association created under N.J.S.A 58:16A-55.5, if the ordinance or resolution delegates authority to approve, conditionally approve, or disapprove municipal stormwater management plans and implementing ordinances.

DEPARTMENT means the New Jersey Department of Environmental Protection.

       

DESIGNATED CENTER means a State Development and Redevelopment Plan Center as designated by the State Planning Commission such as urban, regional, town, village, or hamlet.

DESIGN ENGINEER means a person professionally qualified and duly licensed in New Jersey to perform engineering services that may include, but not necessarily be limited to, development of project requirements, creation and development of project design and preparation of drawings and specifications.

DEVELOPMENT means the division of a parcel of land into two or more parcels, the construction, reconstruction, conversion, structural alteration, relocation or enlargement of any building or structure, any mining excavation or landfill, and any use or change in the use of any building or other structure, or land or extension of use of land, by any person, for which permission is required under the Municipal Land Use Law , N.J.S.A. 40:55D-1 et seq. In the case of development of agricultural lands, development means: any activity that requires a State permit; any activity reviewed by the County Agricultural Board (CAB) and the State Agricultural Development Committee (SADC), and municipal review of any activity not exempted by the Right to Farm Act , N.J.S.A 4:1C-1 et seq.

DRAINAGE AREA means a geographic area within which stormwater, sediments, or dissolved materials drain to a particular receiving waterbody or to a particular point along a receiving waterbody.

ENVIRONMENTALLY CRITICAL AREAS means an area or feature which is of significant environmental value, including but not limited to: stream corridors; natural heritage priority sites; habitat of endangered or threatened species; large areas of contiguous open space or upland forest; steep slopes; and well head protection and groundwater recharge areas. Habitats of endangered or threatened species are identified using the Departments Landscape Project as approved by the Departments Endangered and Nongame Species Program.

EMPOWERMENT NEIGHBORHOOD means a neighborhood designated by the Urban Coordinating Council in consultation and conjunction with the New Jersey Redevelopment Authority pursuant to N.J.S.A 55:19-69.

       

EROSION means the detachment and movement of soil or rock fragments by water, wind, ice or gravity.

IMPERVIOUS SURFACE means a surface that has been covered with a layer of material so that it is highly resistant to infiltration by water.

INFILTRATION is the process by which water seeps into the soil from precipitation.

       

MAJOR DEVELOPMENT means any development that provides for ultimately disturbing one or more acres of land. Disturbance for the purpose of this rule is the placement of impervious surface or exposure and/or movement of soil or bedrock or clearing, cutting, or removing of vegetation.

MUNICIPALITY means any city, borough, town, township, or village.

       

NODE means an area designated by the State Planning Commission concentrating facilities and activities which are not organized in a compact form.

NUTRIENT means a chemical element or compound, such as nitrogen or phosphorus, which is essential to and promotes the development of organisms.

PERSON means any individual, corporation, company, partnership, firm, association, [Borough of Alpine), or political subdivision of this State subject to municipal jurisdiction pursuant to the Municipal Land Use Law , N.J.S.A. 40:55D-1 et seq.

POLLUTANT means any dredged spoil, solid waste, incinerator residue, filter backwash, sewage, garbage, refuse, oil, grease, sewage sludge, munitions, chemical wastes, biological materials, medical wastes, radioactive substance (except those regulated under the Atomic Energy Act of 1954, as amended (42 U.S.C. 2011 et seq.), thermal waste, wrecked or discarded equipment, rock, sand, cellar dirt, industrial, municipal, agricultural, and construction waste or runoff, or other residue discharged directly or indirectly to the land, ground waters or surface waters of the State, or to a domestic treatment works. Pollutant includes both hazardous and nonhazardous pollutants.

RECHARGE means the amount of water from precipitation that infiltrates into the ground and is not evapotranspired.

SEDIMENT means solid material, mineral or organic, that is in suspension, is being transported, or has been moved from its site of origin by air, water or gravity as a product of erosion.

SITE means the lot or lots upon which a major development is to occur or has occurred.

       

SOIL means all unconsolidated mineral and organic material of any origin.

       

STATE DEVELOPMENT AND REDEVELOPMENT PLAN METROPOLITAN PLANNING AREA (PA1) means an area delineated on the State Plan Policy Map and adopted by the State Planning Commission that is intended to be the focus for much of the states future redevelopment and revitalization efforts.

STATE PLAN POLICY MAP is defined as the geographic application of the State Development and Redevelopment Plans goals and statewide policies, and the official map of these goals and policies.

STORMWATER means water resulting from precipitation (including rain and snow) that runs off the lands surface, is transmitted to the subsurface, or is captured by separate storm sewers or other sewage or drainage facilities, or conveyed by snow removal equipment.

STORMWATER RUNOFF means water flow on the surface of the ground or in storm sewers, resulting from precipitation.

STORMWATER MANAGEMENT BASIN means an excavation or embankment and related areas designed to retain stormwater runoff. A stormwater management basin may either be normally dry (that is, a detention basin or infiltration basin), retain water in a permanent pool (a retention basin), or be planted mainly with wetland vegetation (most constructed stormwater wetlands).

STORMWATER MANAGEMENT MEASURE means any structural or nonstructural strategy, practice, technology, process, program, or other method intended to control or reduce stormwater runoff and associated pollutants, or to induce or control the infiltration or groundwater recharge of stormwater or to eliminate illicit or illegal non-stormwater discharges into stormwater conveyances.

TIDAL FLOOD HAZARD AREA means a flood hazard area, which may be influenced by stormwater runoff from inland areas, but which is primarily caused by the Atlantic Ocean.

URBAN COORDINATING COUNCIL EMPOWERMENT NEIGHBORHOOD means a neighborhood given priority access to State resources through the New Jersey Redevelopment Authority.

URBAN ENTERPRISE ZONES means a zone designated by the New Jersey Enterprise Zone Authority pursuant to the New Jersey Urban Enterprise Zones Act, N.J.S.A. 52:27H-60 et. seq.

URBAN REDEVELOPMENT AREA is defined as previously developed portions of areas:

       

       (1) Delineated on the State Plan Policy Map (SPPM) as the Metropolitan Planning Area (PA1), Designated Centers, Cores or Nodes;

       (2) Designated as CAFRA Centers, Cores or Nodes;

       (3) Designated as Urban Enterprise Zones; and

       (4) Designated as Urban Coordinating Council Empowerment Neighborhoods.

WATERS OF THE STATE means the ocean and its estuaries, all springs, streams, wetlands, and bodies of surface or ground water, whether natural or artificial, within the boundaries of the State of New Jersey or subject to its jurisdiction.

WETLANDS OR WETLAND means an area that is inundated or saturated by surface water or ground water at a frequency and duration sufficient to support, and that under normal circumstances does support, a prevalence of vegetation typically adapted for life in saturated soil conditions, commonly known as hydrophytic vegetation.

APPLICANT - A property owner submitting an application for a soil movement permit

       

CLEAN - Broom clean, all soil removed

       

DAY - A calendar day

       

DEVELOPMENT - Improvement of a lot by the construction or erection of one or more buildings for residential, commercial or industrial purposes and improvement of lands through or for conservation or flood control

ENVIRONMENTAL CONSULTANT - An individual or firm retained by the Borough Council, Planning Board or Board of Adjustment The individual or firm shall possess a degree from an accredited institution of higher learning in environmental studies

EROSION AND SEDIMENT CONTROL MEASURES - The standards for soil erosion and sediment control established by the State Soil Conservation Committee

EXCAVATOR - Any person who shall move or remove soil as the terms are hereinafter defined

       

LOT - Any parcel of land or portion thereof the boundary lines of which may be ascertained by reference to the maps and records, or either, in the office of the Tax Assessor of the Borough of Alpine or in the office of the Clerk of Bergen County

MOVE - To dig, to excavate, to remove, to import, to export, to deposit, to place, to dump, to fill, to backfill, to deliver, to grade, regrade or level, to rough grade or fine grade, to level, relocate or otherwise alter or change the location or contour, to transport, to supply, to extract or to shift the location of tree stumps This term shall not be construed to include plowing, spading, cultivating, harrowing or disking of soil or any other operation usually and ordinarily associated with the tilling of soil for agricultural or horticultural purposes

NUISANCE - Any conduct which is either unlawful in itself or unreasonable under all circumstances or the creation or maintenance of a condition which endangers the safety or health of the general public

OWNER - Any person seized in fee simple of any lot

       

PERSON - Any individual, firm, association, partnership or corporation, or any group of two or more of them

SOIL - Any earth, sand, clay, loam, gravel, humus, tree stumps, minerals, mud, silt, ore, muck, stone, rock or dirt, without regard to the presence or absence therein of organic matter, and any debris whether organic or construction debris including but not limited to asphalt, concrete and macadam

SOIL MOVEMENT OPERATION - Delivery or removal of equipment or materials associated with soil movement, soil movement, installation or removal of erosion control measures, starting or warmup of equipment, arrival, departure or waiting of transport vehicles for equipment or soil, street cleaning, restoration, revegetation.

STOCKPILE - A reserve supply of soil accumulated on site in anticipation of future use on or off site

TOPSOIL - Soil that, in its natural state, constitutes the top layer of earth and is composed of 2% or more, by weight, of organic matter and has the ability to support vegetation

DOMESTIC SEWAGE - waste and wastewater from humans or household operations.

       

ILLICIT CONNECTION - any physical or non-physical connection that discharges domestic sewage, non-contact cooling water, process wastewater, or other industrial waste (other than stormwater) to the municipal separate storm sewer system operated by the Borough of Alpine, unless that discharge is authorized under a NJPDES permit other than the Tier A Municipal Stormwater General Permit. Non-physical connections may include, but are not limited to, leaks, flows, or overflows into the municipal separate storm system.

INDUSTRIAL WASTE - non-domestic waste, including, but not limited to, those pollutants regulated under Section 307(a), (b), or (c) of the Federal Clean Water Act (33 U.S.C. §1317(a), (b), or (c)).

MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4) - a conveyance or system of conveyances (including roads with drainage systems, municipal streets, catch basins, curbs, gutters, ditches, manmade channels, or storm drains) that is owned or operated by the Borough of Alpine or other public body, and is designed and used for collecting and conveying stormwater.

NJPDES PERMIT - a permit issued by the New Jersey Department of Environmental Protection to implement the New Jersey Pollutant Discharge Elimination System (NJPDES) rules at N.J.A.C. 7:14A.

NON-CONTACT COOLING WATER - water used to reduce the temperature for the purpose of cooling. Such waters do not come into direct contact with any raw material, intermediate product (other than heat) or finished product. Non-contact cooling water may however contain algaecides, or biocides to control fouling of equipment such as heat exchangers, and/or corrosion inhibitors.

PERSON - any individual, corporation, company, partnership, firm, association, or political subdivision of this State subject to municipal jurisdiction.

PROCESS WASTEWATER - any water which, during manufacturing or processing, comes into direct contact with or results from the production or use of any raw material, intermediate product, finished product, byproduct, or waste product. Process wastewater includes, but is not limited to, leachate and cooling water other than non-contact cooling water.

STORMWATER - water resulting from precipitation (including rain and snow) that runs off the land's surface, is transmitted to the subsurface, is captured by separate storm sewers or other sewerage or drainage facilities, or is conveyed by snow removal equipment.

BLOCK - An area bounded by streets

       

CLEAR SIGHT DISTANCE - A line of unobstructed vision from a point 02 feet above the center line of a street alley to the nearest point on the top of an object four inches high on the same center line

DRAINAGE RIGHT-OF-WAY - The lands required for installation of stormwater sewers or drainage ditches or required along a natural stream or watercourse for preserving the channel and providing for the flow of water therein to safeguard the public against flood damage, to accordance with N.J.S.A 58.1 1

FINAL PLAT - The final map of all or a portion of the subdivision Much is presented to the Planning Board for final approval in accordance with thus chapter and which, if approved, shall be filed with the proper county recording officer

LOT - A parcel or portion of land separated from other parcels or portions by description, as on a subdivision or record of survey map or by metes and bounds, for purpose of sale, lease or separate use

MASTER PLAN - A composite of the mapped and written proposals recommending the physical development of the borough which shall have been duly adopted by the Planning Board

MINOR OR SIMPLE SUBDIVISION - Any subdivision containing no more than two lots fronting on an existing street not involving a planned development, any new street or road, or the extension of any off-tract improvement, the cost of which is to be prorated, pursuant to N.J.S.A 40 55D-42, or the extension of municipal facilities, and not adversely affecting the development of the remainder of the parcel or adjoining property and not in conflict with any provision or portion of the Master Plan, Official Map, Chapter 220, Zoning, or this chapter No more than one minor subdivision shall be allowed on the same original property per two-year period

MINOR SUBDIVISION PLAT - The final map of a tumor subdivision which is presented to the Planning Board for approval to accordance with these regulations and which, if approved, shall be filed with the proper county recording officer

       

OFF-SITE - Located outside the lot lines of the lot in question, but within the property of which the lot is a part, which is the subject of a development application or contiguous portion of a street or right-of-way

OFF-TRACT IMPROVEMENTS - Water, sewer, drainage and street improvements serving a proposed subdivision or development, not located on the property of the subdivision or development, nor on a contiguous portion of a street or right-of-way

OWNER - Any individual, firm, association, syndicate, copartnership or corporation having title in land

PERFORMANCE GUARANTY - Any security which may be accepted in lieu of a requirement that certain improvements be made before the Planning Board or other approving body approves a plat, including performance bonds, escrow agreements and other similar collateral or surety agreements

PLAT - The map of a subdivision

PRELIMINARY PLAT - The preliminary map indicating the proposed layout of the subdivision which is submitted to the Clerk for Planning Board consideration and tentative approval and meeting the requirements of § 195-6 of this chapter

REGULAR OR MAJOR SUBDIVISION - All subdivisions not classified as minor or simple subdivisions

STREET - Any street, avenue, boulevard, road, lane, parkway, viaduct, alley or other way which is an existing state, county or municipal roadway, or a street or way shown on a plat heretofore approved pursuant to law or approved by official action, or a street or way on a plat duly filed and recorded in the office of the county recording officer prior to the appointment of a Planning Board and the grant to such Board of the power to review plats, and including the land between the street lines, whether improved or unimproved, and may comprise pavement, shoulders, gutters, sidewalks, parking areas and other areas within the street lines For the purpose of this chapter, streets shall be classified as follows

       A. PRIMARY STREETS - Those which are used primarily for fast or heavy-traffic

       B. COLLECTOR STREETS - Those which carry traffic from minor streets to the major system of primary streets, including the principal entrance streets of a residential development and streets for circulation within such a development

       C. MINOR STREETS - Those which are used primarily for access to the abutting properties

       D. MARGINAL ACCESS STREETS - Those which are parallel with and adjacent to primary streets and highways, and which provide access to abutting properties and protection from through traffic

       

       E. ALLEYS - Minor ways which are used primarily for vehicular service access to the back or the side of properties otherwise abutting on a street

SUBDIVIDER - Any individual, firm, association, syndicate, copartnership, corporation, trust or any legal entity commencing proceedings under this chapter to effect a subdivision of land for himself or for another

SUBDIVISION - The division of a lot, tract or parcel of land into two or more lots, tracts, parcels or other divisions of land for sale or development The following shall not be considered subdivisions if no new streets are created

       A. Divisions of land found by the Planning Board or Subdivision Committee thereof appointed by the Chairman to be for agricultural purposes where all resulting parcels are five acres or larger in size

       B. Divisions of property by testamentary or intestate provisions

       C. Divisions of property upon court order, including but not limited to judgments of foreclosure

       D. Consolidation of existing lots by deed or other recorded instrument

       E. The conveyance of one or more adjoining lots, tracts or parcels of land, owned by the same person or persons and all of which are found and certified by the Building Inspector to conform to the requirements of the borough development regulations and are shown and designated as separate lots, tracts or parcels on the borough tax map The term "subdivision" shall also include the term "resubdivision" "

SWIMMING POOL - Any pool designed, used and maintained for swimming purposes by any individual for use by his household and guests and located on a lot as an accessory use for a residence

WADING POOL - Any artificially constructed pool, not designed or used for swimming, with an area not exceeding 120 square feet and a maximum depth not exceeding 15 inches

BUFFER AREA - The distance from the side and rear property lines beginning at the front setback line of the lot and running to the rear line in the case of side lines and for the entire width of the rear line 10 feet in the R-1 Zone, 15 feet in the R-AA Zone and 20 feet in the R-A Zone

BUILDING PLOT - A parcel of land upon which a building has been or may be erected in accordance with Chapter 220, Zoning

CONTRACTOR - Any person or business which is in any way responsible for installation and/or removal of trees

IMPROVED LOT - Any clearly defined piece of land which contains a permanently affixed structure with a roof and intended for shelter, housing or enclosures.

OWNER - Any person having the title to any lot, plot, piece or parcel of land

       

PERMITS - A license issued by the Building Inspector to remove or destroy trees, from any improved or unimproved land as defined in this section

PERSON - Any individual, firm, association, partnership or corporation, or any group of two or more of the foregoing

TENANT - Any person in possession of any lot, piece or parcel of land, with or without a lease, but with the permission of the owner

TREE - Any living tree having trunk caliper of six inches or greater measured at a height of three feet above natural grade in a buffer area or having a trunk caliper of nine inches or greater measured at a height of three feet above the natural grade in all other areas outside a buffer area, as defined herein

       

TREE EXPERT - A specialist in trees and tree care

       

UNIMPROVED LOT - Any clearly defined piece of land, the location, dimensions and boundaries of which are determined by the latest official record, upon Mich no structure permanently affixed to the land, with a roof and intended for shelter, housing or enclosure has been constructed

ACCESSORY USE - Either a subordinate use of a building, structure or land or a subordinate building or structure whose use is clearly incidental to the principal use, which is customary in connection with the principal use, and which is located on the same lot as the principal use

ADMINISTRATIVE AGENT The entity responsible for administering the affordability controls of some or all units in the affordable housing program for Alpine to ensure that the restricted units under administration are affirmatively marketed and sold or rented, as applicable, only to low- and moderate-income households

       

MUNICIPAL HOUSING LIAISON The employee charged by the governing body with the responsibility for oversight and administration of the affordable housing program for the Borough of Alpine.

BUFFER STRIP - A strip of land established to physically separate or screen one use or property from an adjacent use or property so as to visually shield or block noise, lights or other nuisances where the adjoining uses are incompatible

BUFFER ZONE - An area of land left in its natural state or landscaped and kept in open space use in order to protect one type of use from another land use that is incompatible

BUILDING - Includes the word "structure "

CONDITIONAL USE - A use permitted in a particular zoning district only upon a showing that such use in a specified location will comply with the conditions and standards for the location or operation of such use as contained in this chapter, and upon the issuance of an authorization therefor by the Planning Board, or, in the case of a "d" variance, the Board of Adjustment

DEVELOPMENT FEES - Money paid by an individual, person, partnership, association, company or corporation for the improvement of property as permitted in COAH's rules [Added 3-22-2000 by Ord. No. 565]

EQUALIZED ASSESSMENT VALUE - The value of a property determined by the Municipal Tax Assessor through a process designed to ensure that all property in the municipality is assessed at the same assessment ratio or ratios required by law Estimates at the time of issuance of a building permit may be obtained utilizing estimates for construction costs Final equalized assessed value will be determined at project completion by the Municipal Tax Assessor [Added 3-22-2000 by Ord. FAMILY - Any number of related individuals, or domestic help which service such family, and living and cooking together as a single housekeeping unit, or not more than two persons not related by blood, marriage or adoption, lawfully occupying a dwelling unit and living as a single, nonprofit housekeeping unit Nothing herein contained shall prohibit any occupancy mandated by N.J.S.A 40 5513-1 et seq

GARAGE DOOR, RESIDENTIAL - A movable, solid barrier used for egress or ingress to a garage. A single garage door shall not exceed a width of ten (10) feet. No garage door shall exceed a height of twelve (12) feet;

GARAGE, PUBLIC - Any structure used for servicing or storing cars for pay to the general public or any structure used for individual or private purposes which does not conform to the definition of a private garage as defined in this chapter The term "public garage" shall be deemed to include service stations

GARAGE, RESIDENTIAL - A structure, either part of, or accessory to, a residential building on the same lot, used for the storage of vehicles.

GRADE, FINISHED The final elevation of the ground level after development.

GRADE, ORIGINAL The elevation of the ground level in its natural state, before construction, filling, or excavation.

HEIGHT OF BUILDING - The vertical distance measured from the average original grade or the average finished grade of the proposed building, whichever is lower, to the highest point of the roof, if the roof is flat, or to a point that is half the distance between the plates and the top of the ridge beam in the case of sloping roofs. The average original grade of the proposed building shall be the average of the reported original grade elevations for all corners and entrances of the proposed building. The average finished grade of the proposed building shall be the average of the reported finished grade elevations for all corners and entrances of the proposed building. Excluded from the calculation of building height shall be chimneys, steeples, handrails for widow's walks and other architectural features that are no greater than four feet (4') in height and which occupy no more than five percent (5%) of the total roof area.

JUDGMENT OF REPOSE - A Judgment issued by the Superior Court approving a municipality's plan to satisfy its fair share obligation [Added 3-22-2000 by Ord. No. 565]

LOT - A parcel of land occupied or capable of being occupied by one building and the accessory buildings or uses customarily incident to it, including open spaces required by this chapter and excluding land within officially recognized rights-of-way The word "lot" also includes the word "plot "

LOT LINE - Any boundary line of a lot

       

LOT LINE, FRONT - Each boundary of a lot which is along an existing or dedicated public street or, where no public street exists, is along a public way A corner lot shall be considered to front on the street or road on which it has the least frontage When a corner lot shall have equal frontage on both streets or roads, or shall have more than the required depth on both streets or roads, the owner may elect which street or road (s)he desires to front on This election shall be made at the time of application for a building permit for the principal building

LOT LINE, REAR - Any lot line other than another front lot line on another street which is opposite a front lot line but not necessarily the same length as the front lot line

LOT LINE, SIDE - Any lot line not a front lot line or a rear lot line

       

       MUNICIPAL HOUSING LIAISON The employee charged by the governing body with the responsibility for oversight and administration of the affordable housing program for the Borough of Alpine.

NONCONFORMING LOT, STRUCTURE OR USE - A lot, the area, dimension or location of which, a structure, the size, dimension or location of which, or a use or activity which was lawful prior to the adoption, revision or amendment of this chapter, but which fails to conform to the requirements of the zoning district in which it is located by reason of such adoption, revision or amendment

       

OCCUPIED - Includes the words "designed" or "intended to be used "

       

PLATE A horizontal timber for carrying the trusses of a roof or the rafters.

RIDGE BEAM The line of intersection at the top between the opposite slopes or sides of a roof.

SUBSTANTIVE CERTIFICATION - A determination by COAH approving a municipality's housing element and fair share plan in accordance with the provisions of the Fair Housing Act and the rules and criteria as set forth herein. A grant of substantive certification shall be valid for a period of six years in accordance with the terms and conditions therein.

YARD, FRONT - A space, unoccupied except as hereinafter provided, within and extending the full width of the lot between the front line and the parts of the building setting back from and nearest such line

YARD, REAR - A space, unoccupied except as hereinafter provided, within and extending a full width of the lot between the rear walls of the main building and the rear lot line

YARD, SIDE - A space unoccupied, except as hereinafter provided, within the lot and between a side lot line and the part of the building erected thereon and nearest thereto The side yard shall extend from the front yard to the rear yard

DISTURBANCE CONTROL CRITERIA - Those criteria set forth in Subsection E(5) of this section

DISTURBANCE - Any physical activity which results in removal of vegetation, modification of topography by cutting or filling, stripping of topsoil, and/or placing of physical structures or improvements thereon

GRADE - The contour or surface of the ground

       

       (a) ORIGINAL GRADE - The natural contour or surface of the ground before any disturbance

       (b) FINISHED GRADE - The contour or surface of the ground at the completion of a project after any disturbance

GRADING - Any disturbance of the original grade by stripping, cutting, filling, stockpiling, or any combination thereof

GRADING LIMITATIONS - The extent of the disturbance allowed in Subsection E(6), Construction control limitation, Column 2, of this section

SLOPE MEASUREMENT CRITERIA - The following slope measurement criteria shall serve as the basic means of identifying and categorizing steep slopes as further regulated under this subsection

       (a) Vertical measurement Vertical measurement shall be determined utilizing two foot contours as documented and determined by on-site survey or the use of photogrammetric aerial topography

       (b) Horizontal measurement Horizontal measurement shall be determined by use of an appropriate scale as required by Borough site plan or subdivision ordinance measuring a minimum horizontal section 30 feet in length

       (c) Application of vertical and horizontal measurements The vertical and horizontal measurements are utilized to determine the slope by measuring the vertical rise on the basis of two-foot contours in a thirty-foot horizontal length

STEEP SLOPE - Includes slopes in excess of 15% in gradient as measured and documented in accordance with the "slope measurement criteria" definition

TRANSITIONAL GRADING - The disturbance in that area of land between the original grade and the finished grade to accommodate roads, parking areas, structures and other like improvements

ANTENNA means a system of electrical conductors that transmit or receive radio frequency signals for wireless communications.

ANTENNA SUPPORT Structure means a structure other than a telecommunications tower which is attached to a building and on which one or more antennas are located.

COLLOCATION means use of a common WTF or a common site by two or more wireless license holders or by one wireless license holder for more than one type of communications technology and/or placement of a WTF on a structure owned or operated by a utility or other public entity.

WIRELESS TELECOMMUNICATIONS FACILITIES (WTF) means facilities for the provision of Wireless Communications services, including, but not limited to, antennas, antenna support structure, telecommunication towers, and related facilities other than WTEFs.

WIRELESS TELECOMMUNICATION EQUIPMENT FACILITIES (WTEF) means accessory facilities serving and subordinate in area, extent and purpose to, and on the same lot as, a telecommunications tower or antenna location. Such facilities include, but are not limited to, transmission equipment, storage sheds, storage buildings, and security fencing.

ALPINE COMMUNITY means the Borough of Alpine, in the County of Bergen and State of New Jersey.

TELECOMMUNICATION TOWER means a freestanding structure on which one or more antennas are located, including lattice towers, guyed towers, monopoles and similar structures.

WIRELESS COMMUNICATION means any wireless services as defined in the Federal Telecommunications Act of 1996 (FTA) which includes FCC licensed commercial wireless

       telecommunication services including cellular, personal communication services (PCS), specialized mobile radio (SMR), enhanced specialized mobile radio, (ESMR), paging, and similar services that currently exist or that may in the future be developed. It does not include any amateur radio facility that is owned and operated by federally-licensed amateur radio station operator or is used exclusively for receive only antennas, nor does it include non-cellular telephone service.

AUTOMOBILE TRAILER, TRAILER COACH OR TRAILER - Any vehicle or structure so designed and constructed in such manner as will permit occupancy thereof as sleeping quarters for one or more persons, or the conduct of any business or profession, occupation or trade, or used as a selling or advertising device, and so designed that it is or may be mounted on wheels and used as a conveyance on highways or city streets, propelled or drawn by its own or other motive power

PARKING SPACE - An off-street space accessible and available for the parking of one motor vehicle and having an area of not less than 200 square feet, exclusive of passageways and aisles appurtenant thereto, but not less than 10 feet in width and not less than 20 feet in length
