A. It is not intended by this Article to repeal, abrogate or impair any existing easements, covenants, deed restrictions or zoning regulations. However, where this Article imposes greater restrictions, the provisions of this Article shall prevail. All other ordinances or local laws inconsistent with this Article are hereby repealed to the extent of their inconsistency only.

B. Disclaimer of liability.

(1) This Article does not imply that areas outside the flood hazard district boundaries or land uses permitted within such districts will be free from flooding or flood damages.

(2) This Article shall not create liability on the part of the Town of Huntington or any officer or employee thereof for any flood damages that result from reliance on this Article or any administrative decision lawfully made thereunder.

C. In their interpretation and application, the provisions of this Article shall be held to be minimum requirements, adopted for the promotion of the public health, safety and welfare. Wherever the provisions of this Article are at variance with other provisions of this Code, or any rules and regulations of the town, the most restrictive or that imposing the higher standards, shall prevail.

D. The excavation or filling of any land, or the use, location, extension, conversion, structural alteration, construction or development of any kind other than in complete compliance with the provisions of this Article shall be an offense.

A. Any person convicted of an offense described in this Article shall be guilty of a violation, which conviction shall be punishable by the imposition of the fine of not more than two hundred fifty dollars ($250.) or by imprisonment for not more than fifteen (15) days, or by both such fine and imprisonment Each day on which such an offense is committed shall be a separate offense.

B. Nothing contained in this Article shall prevent the Town of Huntington from taking such other and further lawful action to prevent or remedy an offense.

C. Notwithstanding the foregoing, the offending premises of anyone convicted of an offense under this Article wherein a variance would have been a complete defense shall be deemed noncompliant and the FEMA shall be notified thereof pursuant to law.
