ARTICLE VIII Off-Street Loading

§198-50. General requirements.

Except for buildings or structural alterations for which a permit was issued prior to June 21, 1966, where loading zones were not required. When any building or structure is hereafter erected or structurally altered to the extent of increasing the floor area by fifty percent (50%) or more, or any building is hereafter converted, for any use listed in Column I of the table (§198-54) of this article, accessory off-street loading spaces shall be provided as required in Column 3 or as required in subsequent sections of this article.



§198-51. Interpretation of provisions.



A. The loading space requirements apply to all districts except the C-6 General Business District and the C-9 Harbor Use District, where no requirements are imposed. [Amended 5-4-2004 by L.L. No. 12-2004]

B. The loading requirements in this article do not limit additional or special requirements which may be imposed in connection with special use permits.



§198-52. Mixed uses in one building.



Where a building is used for more than one use and where the floor area used for each use for which loading space is required is below the minimum for required loading spaces but the aggregate floor area used is greater than such off-street loading space shall be provided as if the entire building were used for that use in the building for which the most spaces are required.



§198-53. Design standards.



A. A loading space is a space within the main building or on the same lot providing for the standing, loading or unloading of trucks. The first required loading space may have a minimum dimension of ten by twenty-five (10 x 25) feet and a vertical clearance of at least twelve (12) feet. Up to one-fourth (1/4) of any additionally required loading spaces may have such dimensions. All other loading spaces shall have a minimum dimension of twelve by thirty-five (12 x 35) feet and a vertical clearance of at least fourteen (14) feet. Loading zones shall be within seventy-five (75) feet of an entrance to the building. [Amended 6-6-1995 by Ord. No. 95-ZC-4]



B. A loading space for a funeral home shall be ten by twenty-five (10 x 25) feet, with a vertical clearance of not less than eight (8) feet.



C. Landbanked loading spaces. When the site plan approval authority can determine that the off-street loading requirement is in excess of the projected demand for the proposed use, the approving authority may permit (approve) a lesser number of spaces to be constructed upon a finding that such modification shall be sufficient to serve the projected demand and that no adverse impacts will result. The site plan shall show the area set aside for the spaces that are not constructed, and the area set aside shall be landscaped and shall not be used for parking, loading, storage or display whatsoever. The area set aside shall comply with all the other requirements of this Article and shall be readily available for construction as a functional loading zone without any disruption or relocation of any other feature of the site, if the site plan approval authority determines that a change in use or a change in operations requires that such additional loading space(s) are warranted. In no case may the approving authority permit the modification so that the site provides less than one-half () the number of spaces required in §198-54. [Added 6-6-1995 by Ord. No. 95-ZC- 4]
