Article VI: Nonconforming Uses, Lots and Buildings.
§ 188-38 Continuance.

Subject to the provisions of § 188-35 and except as otherwise provided in this chapter, the lawful use of land or buildings existing at the date of the adoption of this chapter may be continued, although such use or building does not conform to the regulations specified by this chapter for the zone in which such land or building is located: provided, however, that:

A. No nonconforming lot shall be further reduced in size.

B. No nonconforming structure or lot shall be enlarged, extended or increased, unless such enlargement would tend to reduce the degree of nonconformance.

C. No nonconforming use may be expanded.

§ 188-39 Abandonment.

A.nonconforming use shall be adjudged abandoned when there occurs a cessation of any such use or activity and the owner thereof commits any act indicating an intention to abandon such nonconforming use. An owner's intention to abandon shall be presumed in the event of cessation of any such nonconforming use or activity for a period of 366 consecutive days.

§ 188-40 Reversion.

No nonconforming use shall, if once changed into conforming use, be changed back to a nonconforming use.

§ 188-41 Alterations and extensions.

A.nonconforming structure or an existing structure on a nonconforming lot may be altered or repaired, but not enlarged or extended, unless the enlargement or extension does not violate any front, side or rear yard setback requirements or lot coverage requirements.

§ 188-42 Restoration.

A.nonconforming structure or building may be restored or repaired in the event of partial destruction thereof.

§ 188-43 Future changes.

Whenever this chapter or the Zoning Map shall be modified, amended or supplemented, the foregoing provisions shall also apply to any nonconforming uses, structures or lots created thereby.
