40 : 3-47. OFF-STREET PARKING AND OFF-STREET LOADING REGULATIONS .

ARTICLE 10 Second Industrial District Regulations

40:3-48. APPLICABLE REGULATIONS.

The regulations set forth in this Article, as set forth elsewhere in this Title when referred to in this Article, are the district regulations in Second Industrial Districts. (R.O. 1966 C.S. §27:3-48)

40:3-49. USE REGULATIONS.

40:3-50. HEIGHT REGULATIONS.

The height regulations are the same as those in Fourth Business Districts. (R.O. 1966 C.S. §27:3-50; Ord. 6 S+FB, 12-21-00 § 1; Ord. 6 S+FB, 12-22-04 § 1)

40:3-51. AREA REGULATIONS.

a. Yards. No lot may be created by subdivision that is less than thirty-five (35) feet .de with less than three thousand five hundred (3,500) square feet unless the lot is for a townhouse or attached building development in which case the lot must be at least twenty (20) feet wide. The yard regulations for dwellings are the same as those in Third Residential District.

b. Lot Area per Family. The lot area per family regulation is the same as in Fourth Residence Districts.

c. Reserved

d. Courts. The court regulations are the same as those in Second Business Districts.

40:3-54. USE REGULATIONS.

ARTICLE 12 Hospital District Regulations

40:3-55. APPLICABLE REGULATIONS.

The regulations set forth in this Article, or set forth elsewhere in this Title when referred to in this Article, are the district regulations in the Hospital District. (Ord. 6 S+FU, 3-6-96 §27:3-55)

40:3-56. USE REGULATIONS.

A building or premises shall be used only for hospital purposes, medical office purposes and purposes accessory thereto. Accessory uses to hospitals shall be permitted either on the lot containing the principal use or on a lot in the First Hospital District within two hundred (200) feet of the principal use lot.

Accessory uses to hospitals shall include but not be limited to the following: commercial and other parking structures and lots, nursing beds and nursing home beds, hospice beds or units, child and adult day care centers, treatment and counseling clinics, therapeutic swimming pools, medical and administrative offices, laboratories, staff or trainee residences, laundries and waste treatment facilities for waste generated only by medical facilities on or off site which are under the control of the principal hospital, conference centers and classrooms, research facilities, energy generating equipment, emergency transport facilities, restaurants, cafeterias and snack shops, gift shops, banks, health clubs and pharmacies for hospital and non-hospital customers. 40:3-57. HEIGHT REGULATIONS.

No principal or accessory buildings or structures shall exceed a height of twelve (12) stories nor shall they exceed a height of two hundred (200) feet provided that such building or structures are on a site of at least four (4) contiguous acres and provided that the site coverage by buildings over five (5) stories or fifty-five (55) feet in height does not exceed twenty-five (25%) percent of the site area. Buildings or structures on a site of less than four (4) contiguous acres shall not exceed a height of five (5) stories or filly-five (55) feet. (Ord. 6 S+FU, 3-6-96 §27:3-57)

40:3-58. AREA REGULATIONS.

a. For sites of at least four (4) contiguous acres, new buildings shall be set back a minimum of ten (10) feet from the street line of public streets with the required setback area landscaped with lawn and shrubs except for necessary walkways and driveways. However, where buildings or portions of buildings are two (2) stories or less in height and are across the street from a hospital related use, no setback from the street line shall be required for such buildings or portions of buildings.

b. For sites of less than four (4) contiguous acres, the minimum front, side and rear yards for buildings shall be the same as required in the Third Residential District. (Ord. 6 S+FU, 3-6-96 §27:3-58)

40:3-59. FENCING REGULATIONS.

a. For sites of at least four (4) contiguous acres, the maximum height of fencing shall be twelve (12) feet and such fencing shall be open fencing designed to restrict access rather than restrict views. For sites of less than four (4) contiguous acres, the maximum fence height shall be the same as for fences in the Third Residence Districts. (Ord. 6 S+FU, 3-6-96 §27:3-59)

40:3-60. OFF-STREET PARKING AND LOADING REGULATIONS.

The minimum amount of off-street parking shall be one (1) space for each licensed bed. Such off-street parking shall be provided either on the lot containing the principal use or in the Hospital District within two hundred (200) feet of the principal use lot. All accessory uses shall have access to at least a portion of the spaces designated for the principal use.

The minimum amount of loading shall be one (1) berth for each one hundred thousand (100,000) square feet of gross floor area rounded to the nearest one hundred thousand (100,000) square feet. (Ord. 6 S+FU, 3-6-96 §27:3-60)

ARTICLE 13 Downtown Family Restaurant and Entertainment District

40:3-61. TITLE.

This Article shall hereafter be known and cited as the Downtown Family Restaurant and Entertainment District. (Ord. 6 S+FM, 11-1-00 § 1)

40:3-62. PURPOSE.

a. The purposes of this Article are to establish the Downtown Family Restaurant and Entertainment District and define its boundaries.

b. This Article is not intended to create a new zone. All current zoning controls in effect within the district's boundaries shall remain in effect. (Ord. 6 S+FM, 11-1-00 § 1)

40:3-63. BOUNDARIES.

The boundaries of the Downtown Family Restaurant and Entertainment District shall be:

The northern border shall begin at the northerly side of Clay Street from the bank of the Passaic River, west to Broad Street, south on the westerly side of Broad Street to Lackawanna Avenue, west to Dr. Martin Luther King, Jr. Boulevard. The western border shall run south along the westerly side of Dr. Martin Luther King, Jr. Boulevard from Lackawanna Avenue to Springfield Avenue, then west along the northerly side of Springfield Avenue to Fairmount Avenue, then east along the southerly side of Springfield Avenue to Martin Luther King, Jr. Boulevard, then north along the westerly side of Martin Luther King, Jr. Boulevard which shall include all the tax lots with frontage along identified portions of Springfield Avenue contained therein, as shown on the official tax map of the City of Newark to Spruce Street. The southern border shall run east on the southerly side of Spruce Street and continue on Lincoln Park across Broad Street to the southerly side of Chestnut Street, and continue to New Jersey Railroad Avenue. The eastern border shall run northeast along the westerly side of New Jersey Railroad Avenue to Market Street, northeast along the westerly side of Raymond Plaza East to the bank of the Passaic River, and continue north along the bank of the Passaic River to Clay Street.

40:3-64. ADDITIONAL REGULATIONS.

In addition to the zoning controls in effect within the Downtown Family Restaurant and Entertainment District, establishments serving food and drinks shall adhere to Title 29 "Streets and Sidewalks," and Title 4 "Alcoholic Beverages" of the Revised Ordinances of the City of Newark, as well as any and all other applicable Ordinances.
