§ 322-63. Truck-loading space schedule.

Every building or structure, lot or land used for nonresidential purposes shall be provided with off-street truck-loading spaces in accordance with the following schedule:

§ 322-64. Access driveway requirements.

A. Access driveways for parking garages, public parking areas, filling stations, repair garages or trucking stations may have separate or combined entrances and exits.

B. Every entrance or exit driveway shall have a minimum unobstructed width of 10 feet. Every combined entrance and exit driveway shall have a minimum unobstructed width of 20 feet. Larger widths may be required on some sections of driveway in accordance with the provisions of § 322-65. [Amended 10-21-1986]

§ 322-65. Design requirements.

A. The schedule of minimum parking setbacks for uses other than one- or two-family dwellings shall be as follows:

B. The physical improvements of off-street parking and truck-loading areas shall include:

(1) Paving in accordance with the Type A specification of the Town of Smithtown Subdivision Regulations, or equivalent, for nonresidential parking and a stabilized, all-weather surface for residential parking.

(2) Drainage facilities complying with the standards and design requirements of the Town of Smithtown Subdivision Regulations.

(3) Adequate lighting in public parking areas to assure the general safety and convenience of the public.

(4) Appropriate planting and fencing for the protection of adjacent properties, particularly along zone district boundary lines as provided for in § 322-20.

C. All access driveways within parking areas shall have a minimum width of 24 feet when the parking spaces are at an angle of 90 degrees with the driveway, 18 feet when the parking spaces are at 60 degrees and 12 feet when the parking spaces are at 45 degrees. [Amended 5-23-1967]

D. Driveways and turning areas shall have adequate radii to assure ease of mobility, ample clearance and convenient access and egress.

E. Center-line gradients of all access driveways shall not exceed 8%.

F. Accessory off-street parking areas shall be marked off into parking spaces with a minimum width of nine feet and a minimum length of 18 feet or in the case of parking spaces for trucks or special equipment, parking spaces of a minimum size to be determined by the Engineer based on the nature of the parked vehicle. G. Truck-loading spaces adjacent to tailgate level loading docks and/or for retail, wholesale, storage, distribution and manufacturing buildings exceeding 5,000 square feet gross floor area or on one-acre sites or larger shall be at least 65 feet long by 12 feet wide by 14 feet in height. Driveways, aisles, parking areas and truck maneuvering areas shall be provided, constructed and maintained so as to permit trucks having greater than 10,000 square feet, straight maximum truck permit, New York State, to enter and exit the site to and from public streets while moving in forward gear and without having to shift into reverse gear more than once. Turning vehicle templates approved by AASHTO shall be used in the site plan review procedure pursuant to Article XIII to determine the sufficiency of the site design. [Amended 10-21-1986]

H. Curbs shall have a radius of at least three feet where a parking space intersects with an aisle and/or driveway. [Added 10-21-1986]

I. The required parking space shall be kept free of charge to users of the site. Parking spaces shall have continuous unobstructed access to and from aisles, driveways and public streets at all times for residential users and during business hours for nonresidential uses. Driveways, aisles and parking spaces shall not be encroached upon by charity drop boxes, truck-loading spaces or maneuvering areas, outdoor storage or any other object which would prevent their use in accordance with the intent of this article. Refuse bin enclosures shall not encroach upon more than one parking space per site. [Added 10-21-1986; amended 11-24-1992]

J. On all sites larger than two acres, planting islands shall be provided in parking areas at the ends of rows of parking spaces in order to channelize traffic and provide for a high standard of aesthetic character. The length of rows shall not exceed 20 spaces. Each island shall have a minimum length of 18 feet and a minimum width of nine feet. [Added 10-21-1986]

K. The parking requirement of any site being retrofitted to comply with the Americans with Disabilities Act shall be reduced to the extent necessary to comply with the Act. [Added 11-24-1992]
