ARTICLE 1.1 PURPOSES
Section 1.1.1 Purposes

The purposes of this Ordinance are to encourage the most appropriate use of land throughout the Township, to conserve and stabilize the value of property, to prevent the over-crowding of land and buildings, to provide for appropriate population densities, to provide ail appropriate variety of available housing to satisfy the needs of its citizens and to satisfy the obligation of the Township to provide affordable housing. to encourage senior citizen community housing construction; to encourage the redevelopment of the business district, to lessen congestion in the streets, to secure safety from tire, flood, panic and other dangers; to facilitate adequate provisions for community utilities and facilities such as transportation, water, sewerage, schools, parks, playgrounds, recreation, conservation and other public requirements, to provide adequate open spaces for fight and all, to promote health, safety, morals and the general welfare, to encourage the appropriate and efficient expenditure of public funds by the coordination of public development with land use policies, to promote a desirable visual environment through creative development techniques and good civic design and arrangement, to prevent damage to the physical environment, to discourage Uses of land which are no longer appropriate for the community, and to accomplish such other projects and purposes of zoning as are now and may be hereinafter set forth in the enabling legislation For any of these purposes, this ordinance designates, regulates and restricts the location and use of buildings, structures, and land for residence, commerce trade industry, recreation, conservation or other purposes, the height. number of stories, and size of buildings and other structures hereafter erected and/or altered, the size of yards and other open spaces, and the density of population In order to effect its purposes, the Ordinance divides the Township into Zoning Districts of such number, shape and area deemed best to carry out the purposes, designs and objects of this Ordinance, to comply with the terms of an Order of Compliance entered by the Superior Court of New Jersey in the matter entitled Deland and Scarpa v Township of Berkeley Heights, Docket No L-73036-87, and other purposes within the delegated powers provided in C. 291, P L 1975 ( title 40. Chapter 55D of the New Jersey Revised Statutes, "The Municipal Land Use Law"), its amendments and supplements thereto.
