18A-1 General Provisions.
18A-1.1 Title.

This ordinance shall be known and may be cited as "The Land Use Procedures Ordinance of the Town of Newton".

18A-1.2 Copies to be Filed with County Planning Board.

Immediately upon adoption of this chapter, the town clerk shall file a copy of this chapter with the county planning board, as required by law. The clerk shall also file with the county planning board, copies of all other ordinances of the town relating to Land Use, such as the Subdivision, Zoning and Site Plan Review Ordinances.

18A-1.3 Definition of Terms.

Whenever a term is used in this chapter which is defined in R.S. 40:55D, such term is intended to have the meaning set forth in the definition of such term found in the statute, unless a contrary intention is clearly expressed from the context of this chapter.

18A-1.4 Pending Applications.

All applications for development filed prior to the effective date of this chapter may be continued, but any appeals arising out of decisions made on any such application shall be governed by the provisions of section 5 of this chapter.

18A-1.5 Construction.

This chapter shall be considered part of and shall be read in para materia with the land subdivision chapter, the zoning chapter and the site plan review ordinance of the town.

18A-1.6 Repeals.

All sections of the Land Subdivision Ordinance, Zoning Ordinance, Site Plan Review ordinance, or any other ordinance of the town which contain provisions contrary to the provisions of this chapter shall be and are hereby, to the extent of such inconsistency, repealed.

18A-1.7 Effective Date.

This chapter shall take effect on September 1, 1976.
