All of the provisions of this article shall be applicable to a minor development. However, any of the provisions of this article may be waived by the Borough Engineer and/or reviewing board, provided that the applicant demonstrates that the applicant has otherwise complied with all other applicable best management practices.

The low-impact development checklist as is specified in Appendix A of the New Jersey Stormwater Best Management Practices Manual adopted by NJDEP is hereby adopted by reference and incorporated herein. All applications for development shall include a completed low-impact development checklist.

This article shall take effect immediately upon the approval by the county review agency, or 60 days from the receipt of the ordinance by the county review agency if the county review agency should fail to act.

If the provisions of any section, subsection, paragraph, subdivision, or clause of this article shall be judged invalid by a court of competent jurisdiction, such order of judgment shall not affect or invalidate the remainder of any section, subsection, paragraph, subdivision, or clause of this article.
