ARTICLE I. Title; Purpose; Approving Agency
§ 191-1. Short title.

This chapter shall be known and may be cited as the "Site Plan Review Ordinance of the Borough of Hopatcong."

§ 191-2. Purpose.

The purpose of this chapter shall be to provide rules, regulations and standards to guide the appropriate use and development of land in the Borough of Hopatcong in order to promote the public health, safety, convenience and general welfare of the municipality. It shall be administered to ensure the orderly growth and development, the conservation, protection and proper use of land and adequate provision for circulation, utilities and services.

§ 191-3. Administration of approval provisions.

A. The approval provisions of this chapter shall be administered by the Borough of Hopatcong Planning Board and, where permitted by statute, by the Zoning Board of Adjustment in accordance with all applicable provisions of N.J.S.A. 40:55D-1 et seq.

B. The Planning Board shall have the power to review and approve or deny conditional uses and site plans simultaneously with review for subdivision approval without the developer being required to make further application to the Planning Board or the Planning Board being required to hold further hearings. The longest time period for action by the Planning Board, whether it is for subdivision, conditional use or site plan approval, shall apply. Whenever approval of a conditional use is requested by a developer, notice of the hearing on the plat shall include reference to the request for such conditional use. The developer shall file the appropriate applications separately and pay all applicable fees.

C. The Zoning Board of Adjustment shall have the power to grant, to the same extent and subject to the same restrictions as the Planning Board, site plan approval whenever the Board of Adjustment is reviewing an application for a use variance, pursuant to N.J.S.A. 40:55D-70d.
