§134-60 Development review fees

The developer shall, at the time of filing a submission, pay the following nonrefundable fees to the Township of Wayne by cash, certified check or bank money order, except that no fees shall be charged for informal review of a concept plan for development Proposals involving more than one (1) use shall pay a fee equaling the sum of the fees for the component elements of the plat Proposals requiring a combination of approvals, such as subdivision, site plan and/or a variance, shall pay a fee equal to the sum of the fee for each element, except that in the case of a planned development application involving both a subdivision and site plan review, only payment of the site plan fees shall be required

A. Minor subdivision

(1) One hundred dollars ($100), plus fifty dollars ($50 ) per lot.

B. Major subdivision

(1) Informal review, sketch plat, concept plan two hundred fifty dollars ($250) The amount shall be credited toward fees for the review of the application for development if applied for within one (1) year of the date of such review [Amended 7-18-1990 by Ord No 56-1990]

(2) Preliminary plat two hundred fifty dollars ($250 ), plus one hundred dollars ($100) per lot

(3) Final plan, planning- two hundred fifty dollars ($250), plus fifty dollars ($50) per lot, engineering inspection ninety-two dollars ($92) per lot [Amended 12-4-1991 by Ord No 78-1991]

(4) Modification of any approved major subdivision five hundred dollars ($500)

C. Site plans

(1) Planning development

(a) For initial application Upon submission of an application for zone change for a planned development, the developer shall submit a fee of two thousand dollars ($2,000), or fifty dollars ($50) per acre, or any part thereof, of the gross site area, whichever is greater The funds thus received by the township shall be deposited in an escrow account, and such funds shall be utilized to pay the fees and costs of any professional personnel employed by the Township of Wayne to process, review and make recommendations on the proposed zone change application Any of the aforesaid moneys left in the escrow account, upon favorable action by the Planning Board, shall be credited to the applicant toward those fees which shall arise under preliminary and final approval review In the event that the zone change application is unsuccessful, the amount remaining in the account shall be returned forthwith to the developer Should additional funds be required after the original funds are exhausted, the developer will be notified of the amount and reasons therefor

(b) Preliminary approval, one hundred dollars ($100) per Dwelling unit

(c) Final approval, planning- fifty dollars ($50) per Dwelling unit, engineering inspection ninety-two dollars ($92) per Dwelling unit [Amended 12-41991 by Ord No 78-1991]



(d) Modification of any approved site plan five hundred dollars ($500 )

(2) Any multifamily use of three (3) or more units

(a) Preliminary approval one hundred dollars ($100) per Dwelling unit

(b) Final approval, planning- fifty dollars ($50) per Dwelling unit, engineering inspection, forty-six dollars ($46) per Dwelling unit [Amended 12-41991 by Ord No 78-1991]

(c) Modification of any approved site plan five hundred dollars ($500 )

(3) Commercial, office or industrial buildings or the uses listed in § 134-131C, except that no fee shall be charged in the case of a site plan for a firehouse or first-aid building

(a) Preliminary site plan two hundred fifty dollars ($250 ), plus five cents ($0.05) for every square foot of gross floor area of new construction

(b) Final site plan, planning- one-half (1/2) preliminary site plan fee, engineering inspection one hundred fifty dollars ($150 ) per ten thousand (10,000) square feet of new building or part thereof (Amended 124-1991 by Ord No 78-1991]

(c) Modification of any approved site plan five hundred dollars ($500 )

(4) For the uses listed in § 134-131G

(a) Preliminary site plan for fence or outside air conditioner two hundred fifty dollars ($250 )

(b) Preliminary site plan for all other uses listed five hundred dollars ($500)

(c) Final site plan one-half ($500) of the preliminary site plan fee

(d) Modification of any approved site plan two hundred fifty dollars ($250)

D. Variances

(1) Hear and decide appeals one hundred dollars ($100)

(2) Interpretation of the zoning regulations or Zoning Map one hundred dollars ($100)

(3) Hardship or special reason variance

(a) Single-family residential



[1] One hundred dollars ($100) for gross floor area of one (1) square foot to one hundred (100) square feet of all residential structures, additions and accessory structures and uses, including variances for height.

[2] One hundred fifty dollars ($150 ) for gross floor area of one hundred one (101) square feet to six hundred (600) square feet of all residential structures and additions

[3] Two hundred dollars ($200) for gross floor area of six hundred one (601) square feet to one thousand (1,000) square feet of all residential structures and additions

[4] Two hundred fifty dollars ($250 ) for gross floor area of one thousand one (1,001) square feet and over of all residential structures and additions

(b) Nonresidential two hundred fifty dollars ($250 )

(4) Use variance five hundred dollars ($500), plus five hundred dollars ($500 ) per acre or part

(5) Building permit in conflict with Official Map or building permit for lot not related to a street- two hundred fifty dollars ($250)

E. Conditional uses one hundred fifty dollars ($150)

F. Public hearing For those development applications which require public notice of hearing pursuant to § 134-69 of this chapter one hundred fifty dollars ($150)

G. Reproduction of records

(1) Duplication of tape recordings seventy-five dollars ($75)

(2) Use of tape recordings for transcript purposes (appellant to supply his own stenographer to make transcript) one hundred fifty dollars ($150 )

H. Change of zone request application five hundred dollars ($500), plus five hundred dollars ($500) per acre or any portion thereof

I. Soil removal inspection. fifty dollars ($50)

J. Soil removal permit

K. Special Permit Clothing Receptacles - $100.00.

L. Blasting fees Every development application in which blasting work is required to prepare the property for development shall pay an additional fee to the township equal to the amount necessary to reimburse the township for fees it incurs to obtain an independent review of the effects of such proposed blasting procedures

M. [Added 11-1-1989 by Ord No 79-1989] Fees and escrow deposits for development applications The Planning Board and/or Zoning Board of Adjustment shall require fees and escrow deposits in accordance with the provisions of this chapter Such funds shall be utilized to pay the cost of professional fees, including certified shorthand reporting fees incurred for review of and/or testimony concerning an application for development submitted by an applicant

(1) Escrow schedule

(a) Subject to the provisions of Subsection M(l)(b) hereof, each applicant shall, prior to the application being ruled complete pursuant to the provisions of Municipal Land Use Law, submit the following sum(s) to be held in escrow in accordance with the provisions hereof
