ARTICLE VIII Garden Apartment Districts
§211-36 Permitted uses and structures.

In Garden Apartment Districts, no lot, plot, parcel or tract of land shall be used and no building or other structure shall be built, altered or erected to be used for any purpose other than that of

A. Multifamily structures consisting of four (4) or more Dwelling units contained in separate or attached structures

B. A sign identifying an apartment project and located at the entrance or entrances to such project and limited to 30 square feet in area. The design, location, landscaping and maintenance of such sign shall be in accordance with specifications and conditions determined by the Planning Board. All LED, digital, animated, scrolling, flashing, or any other form of electronic sign, are prohibited.

C. Customary accessory buildings

D. Satellite dish, as herein defined. subject to the standards as set forth in Article XIX, Conditional Uses, of this chapter [Added 6-19-85 by Ord. No 30-1985, amended 9-18-85 by Ord No 48-1985]

E. Community residences and community shelters as set forth in Section 211-3K.

§211-37 Minimum area. and width, maximum height

A. The minimum size of garden apartment sites shall be five (5) acres The minimum lot width shall be two hundred fifty (250) feet.

B. The maximum height of apartment structures shall not exceed two and one-half (2 1/2) stones

§211-38. Setback.

No building shall be closer to any street line than

A. One hundred (100) feet along Paterson-Hamburg Turnpike

B. One hundred (100) feet along all other main thoroughfares, except that a seventy-five-foot setback may be permitted for a building containing no more than four (4) Dwelling units, provided the adjoining or attached group of four (4) Dwelling units is set back at least twenty (20) feet further from the main thoroughfare Such main thoroughfares in Garden Apartment Districts include Berdan Avenue, Oldham Road, Hinchman Avenue, Valley Road (and its proposed extension) and Preakness Avenue

C. Forty (40) feet along all interior streets and roads

§211-39. Rear and side yards.

A. The minimum depth of a rear yard shall be fifty (50) feet.

B. The minimum width of a side yard shall be not less than seventy-five (75) feet where any residence district adjoins a Garden Apartment District and not less them forty (40) feet in all other cases.

§211-40. Distance between structures.

The minimum distance between structures shall be thirty (30) feet, except that where an access drive is located between structures, the minimum distance between them shall be fifty (50) feet.

§211-41. Maximum length of structures

No more than twenty (20) Dwelling units shall be contained in any one (1) continuous structure, and there shall be no more than twelve (12) Dwelling units in any unbroken building line A setback of not less than four (4) feet shall be deemed a satisfactory break in the building line

§211-42 Density, maximum lot coverage.

A. The maximum density permitted shall be thirteen (13) Dwelling units per acre The maximum number of units to be constructed with two (2) bedrooms shall be not more than twenty percent (20%) of the Dwelling units permitted per acre [Amended 8-5-64 by Ord No 44-1964]

B. Garden apartment structures shall not occupy more than twenty percent (20%) of the gross lot area

§211-43. Recreation space.

At least fifteen percent (15%) of the gross site area shall be devoted to recreation areas, not including paved parking and access drive areas The areas set aside for recreation purposes shall provide for common open spaces and facilities suitable to serve the residents of the apartment development They may include playgrounds, areas containing facilities for active recreation and sitting areas No such recreation space shall be located in any front or side yard along Paterson-Hamburg Turnpike or along any other main thoroughfare as designated in § 21138B of this Article

§211-44. Width of interior access roads.

The minimum right-of-way width of interior access roads shall be fifty (50) feet

§211-45 Minimum size of apartments.

Every Dwelling unit shall provide living floor space in conformity with the following schedule.

§211-46. Off-street parking.

At least one and three-fourths (1%) off-street parking spaces shall be provided for each Dwelling unit, of which at least one-half (1/2) space per Dwelling unit shall be in garages. No off-street parking shall be located in any front or side yard along PatersonHamburg Turnpike or along any other main thoroughfare referred to in § 211-38, nor in any front yard or front court, nor shall any off-street parking be permitted within ten (10) feet of any apartment building structure

§211-47. Garages and accessory buildings.

A. Every garage shall have a floor area of not less than two hundred forty (240) square feet, and such garage may be built into the apartment structure or separately constructed as hereinafter provided

B. No garage or other accessory building shall be placed nearer to a side or rear property line than ten (10) feet, except that in the case where apartment developments adjoin each other, garages may be built back-to-back along the common property line

C. Each group of attached garages shall have a joint capacity of not more than ten (10) automobiles arranged in a row, except that in the case where garage buildings are built back-to-back as permitted in Subsection B of this section, twenty (20) automobiles may be housed therein There shall be a minimum distance of ten (10) feet between garage structures.

D. Garages and other accessory buildings shall be no more than one (1) story in height The architectural design and the materials used in the construction thereof shall conform to the design and the building materials used in the construction of the garden apartment structures No part of any garage or other accessory building shall be used for living purposes

§211-48. Review and approval.

Review and approval of the Planning Board shall be required for all garden apartment uses permitted hereunder, as provided in 211-126 hereof
