§211-2. Classes of districts; boundaries established; regulations.

A.For the purposes of this chapter, the township is divided into the following classes of districts.

B. The boundaries of the aforesaid zone districts shall be as shown on the map entitled 'Wayne Township, Passaic County, NJ, Wayne Township Planning Board Zoning Map, revised December 5, 1988," amended in accordance with the provisions of this chapter and as thereafter, from time to time, revised and amended by ordinance The Zoning Map, as may be amended and revised, shall be on file in the office of the Department of Planning of the township and is hereby incorporated in and made a part of this chapter as though appended hereto [Amended 1-3-1979 by Ord. SECTION 3. Chapter 211 (Zoning), Section 211-2(B) is hereby amended and supplemented by placing all properties fronting along the state highway Route 23 corridor in both northerly and southerly direction that are presently zoned B (Business) and SB (Special Business) as highway commercial district and the Wayne Township, Passaic County, N.J., Wayne Township Planning Board Zoning Map revised December 5, 1988 shall be so amended and revised. | |||||||

C. All buildings and other structures and all uses of buildings and other structures shall conform to the requirements and regulations of the district in which such buildings or structures are located and in which such uses are conducted. Nonconforming buildings, structures and uses may be continued, subject, however, to the special regulations provided in this chapter [Amended 10-5-1988 by Ord. No. 59-1988]

D. Zone boundary changes
| |||||||
(1) All applications initiated by an applicant which propose changes in the boundaries of the zoning districts shall originate with the Planning Board, and the Planning Board shall conduct a public hearing on each such application, the same as in the case of a hearing on a major subdivision application as provided for in § 182-13 of Chapter 182, Subdivision of Land, within forty-five (45). days after application has been filed, the Planning Board shall either deny the application and state in writing the reasons therefor or recommend to the Municipal Council that the application be approved and that an ordinance enabling the change of zone be adopted,

(2) At least ten (10) days prior to the public hearing conducted by the Municipal Council on any ordinance which proposes to change the boundaries of the zone districts or to designate specific premises for park purposes, the Township Clerk shall mail a copy of the ordinance to all owners of the property which is the subject of the proposed zone change or parcel designated for park purposes and to all property owners within two hundred (200) feet of such property Such mailing shall be directed to the last known post office addresses of such owners as shown by the most recent tax lists of the township When the zoning change is initiated by an applicant other than the township, the applicant, instead of the Township Clerk, shall be responsible for mailing a copy of the notice to such property owners and shall deliver to the Township Clerk proof of mailing in the form of an affidavit

(3) All applicants shall deposit an amount as provided in Chapter 75, Fees, as a filing fee with their applications [Amended 9-21-1988 by Ord. No. 54-1988]

(4) In the case of an unfavorable recommendation by the Planning Board, such a change of zone shall not become effective except by a favorable vote of the majority of the full authorized body of the Municipal Council as provided in N.J.S. A. 40 55D-26 [Amended 10-5-1988 by Ord. No. 59-1988]
