ORDINANCE NO. 4125 07 ZONING MAP AMENDMENT

ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 348 (LAND USE AND DEVELOPMENT REGULATIONS) OF THE "CODE OF THE TOWNSHIP OF TOMS RIVER, NEW JERSEY" (REZONING OF BLOCK 120, LOT 3.03, BLOCK 120, LOTS 3.01, 3.02 AND 10, BLOCK 120.10, LOT 4, BLOCK 299, LOT 147 AND TO CORRECT MAPPING ERRORS RELATING TO BLOCK 298, LOT 40, AND BLOCK 442.15, LOTS 5, 6, 26 AND PART OF LOT 3.01)

WHEREAS, Block 120, Lot 3.03, Block 120, Lots 3.01, 3.02 and 10, Block 120.10, Lot 4 and Block 299, Lot 147 are currently zoned R-800; and

WHEREAS, Block 298, Lot 40 is currently zoned R-150; and

WHEREAS, Block 442.15, Lots 5, 6, 26 and part of Lot 3.01 are currently zoned R-75; and

WHEREAS, the Toms River Township Planning Board and the Land Use Committee of the Township Council have discovered certain inadvertent errors which appear on the official zoning map of the Township; and

WHEREAS, the Township Council is in agreement with the recommendation by the Planning Board and the Land Use Committee to correct the official zoning map and confirm the proper zoning of the above-mentioned blocks and lots; and

WHEREAS, certain other properties have been recommended by the Township Planning Board for rezoning as part of its periodic review of the Township aster Plan pursuant to N.J.S.A. 40:55D-89;

NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township of Toms River, in the County of Ocean, and State of New Jersey, as follows:

3. The Township Council authorizes and directs that the official Zoning map of the Township be amended to reflect the proper zoning designation as set forth above in paragraph 1.

4. The enhanced notice provisions of the Municipal Land Use Law do not apply since the rezoning set forth in paragraph 2 above are the result of recommendations of a Master Plan periodic review.

5. All ordinances and parts of ordinances inconsistent herewith are hereby repealed.

6. This ordinance shall take effect upon final adoption and publication pursuant to law.

7. A copy of this proposed ordinance together with a notice of hearing shall be immediately served by the Office of the Township Clerk by certified mail return receipts requested upon the Ocean County Planning Board and the municipal clerks of the following municipalities:

a) Beachwood

b) Berkeley Township

c) Brick Township

d) Island Heights

e) Jackson Township

f) Lakewood

g) Lavallette

h) Manchester Township

i) Ocean Gate

j) Pine Beach

k) Seaside Heights

l) South Toms River
