This zone districts designed for one-family residences and garden apartments but permits any use as regulated in subsection 19-5 1101 (Ord #2-77, 129-5 1201) | |||||||
| |||||||
Any use other than those listed in subsection 19-5 1201 is prohibited (Ord #2-77, 19-5 1202) | |||||||
| |||||||
Garden apartment building permits shall not be issued unless construction and site plans thereof shall comply with all of the following requirements, all other uses in this district shall comply with subsection 19-5 1104 with respect to height, yards and area. | |||||||
a. Height No building shall exceed a maximum of two (2) stories and no building shall have a height greater than thirty (30') feet
| |||||||
b. Yards No principal building shall be located closer than fifty (50') feet to any property line. Accessory structures, recreation facilities and parking are permitted in the side and rear yards, provided no accessory structure, recreation facilities or parking area shall project closer than twenty (20') feet to any property line
| |||||||
c. Minimum Space Between Buildings There shall be a minimum open space between all buildings in compliance with the following schedule.
| |||||||
1. A minimum distance of forty (40') feet between principal buildings so arranged that the end of one building faces the end of another building
| |||||||
2. A minimum distance of sixty (60') feet between principal buildings so arranged that the end of one building faces the front or rear of another building
| |||||||
3. A minimum distance of sixty (60') feet between principal buildings so arranged that either the front or rear of one building faces the front or rear of another building
| |||||||
4. The width of an open courtyard formed by a principal building shall not be less than sixty (60') feet, there shall be no closed courtyards
| |||||||
5. A minimum distance of fifteen (15') feet shall be required between accessory structures
| |||||||
d. Minimum Lot Area No garden apartment building or buildings shall be erected or constructed upon lots containing an area of less than four (4) acres measured within six hundred ninety-five (695') feet of the front property line; and no such lot shall have a lot frontage of less than two hundred fifty (250') feet.
| |||||||
e. Unit Density. There shall be a minimum of eight (8) apartments in each garden apartment building The maximum number of apartment units in each garden apartment building shall not exceed sixteen (16) units and not more than four (4) ground floor units in a row Any angular break in the building line shall be not less than forty-five (45 ) degrees
| |||||||
f. Density of Development Not more than ten (10) apartment units shall be permitted for each acre of land in the lot upon which garden apartment buildings are to be constructed
| |||||||
g. Rooms For the purpose of this Section, a bedroom shall be construed to be any separate room other than a living room, dining room, kitchen or bathroom. Each apartment unit in each garden apartment building shall contain as a minimum a separate bedroom, a separate living room, a separate bath and a separate kitchen, which kitchen facility shall be located separate and apart from the other rooms in the apartment unit, In each garden apartment development, at least eighty-five (85%) Percent of the dwelling units thereof shall be one (1) bedroom units and not more than fifteen (15%) percent thereof shall be two (2) bedroom units Only one (1) and two (2) bedroom units shall be permitted

i Location of Units Within Building No garden apartment unit or portion thereof shall be located in the basement or attic of any garden apartment building | |||||||
j. Parking For all garden apartments, there shall be provided not less than two (2) parking spaces for each apartment unit which may include garage space for the sole and exclusive use of the tenants All parking areas shall comply with the provisions of subsection 19-5.802

k. Access Drives. Access drives shall be installed providing adequate circulation within the garden apartment development as well as access to all parking areas and to public thoroughfares All access drives shall be paved and curbed to meet Township road specifications All access drives shall have minimum pavement width of twenty-four (24') feet for two (2) way circulation and eighteen (18') feet for one (1) way circulation

l. Curbing. There shall be poured concrete or Belgian block curbs meeting Township specifications around the perimeter of all parking areas and access drives.
| |||||||
m. Storm Drainage All parking areas and access drives shall be provided with an adequate system of storm drainage approved by the Township Engineer.
| |||||||
n. Walks, There shall be an adequate system of walks leading from all apartment units to all parking areas, along access drives and along front streets, such walks to be installed to meet Township specifications
| |||||||
o Ventilation Every garden apartment shall be designed to provide not less than two (2) exterior exposures with windows so as to provide either through ventilation or cross ventilation | |||||||
p. Construction. All buildings shall be constructed in accordance with the Building Code meeting specifically the requirements of Section 707, Ordinary Construction, shall comply with all requirements of the Fire Code and in addition
| |||||||
1. The exterior of each garden apartment building shall be of brick or stone facing, solid brick, stone or some other acceptable masonry material, provided asbestos shingles or cinder block as an exterior finish is prohibited.
| |||||||
2. The exterior of all accessory structures shall be in harmony architecturally with and be constructed of materials of a like character to those used in the principal structures
| |||||||
3. All stairways shall be constructed and contained within the apartment buildings.
| |||||||
4. There shall be constructed, in accordance with specifications approved by the Building Inspector, sound retardant fire walls and sound retardant ceilings between each garden apartment unit
| |||||||
q. Utilities Every garden apartment unit and garden apartment building shall be supplied with water from the public water system of the Township or one approved by the Township Council All sanitary or domestic sewage shall be collected into and disposed of through a public sewer system operated or approved by the Township Fire hydrants shall be installed by the developer in adequate numbers and at locations approved or recommended by the Township Engineer and the Public Safety Committee

r. Storage. A storage space of not less than seven hundred (700) cubic feet exclusive of living and garage space shall be provided for each dwelling unit.
| |||||||
s. Laundry Facilities Each garden apartment building shall contain separately partitioned clothes washing and drying areas of at least ten (10) square feet of floor area for each dwelling unit. All laundry facilities shall be for the exclusive use of the occupants of the apartment units and shall be contained within the confines of completely enclosed buildings No clothes lines or clothes hanging devices or washing, drying or laundering facilities of any kind whatsoever shall be located outside the confines of completely enclosed buildings,

t. Garbage Disposal. There shall be no unenclosed or uncovered garbage disposal facilities Garbage disposal facilities and receptacles shall be placed within the confines of buildings enclosed on all sides, or shall be buried in the ground in such a manner that the receptacles are easily removable.

The covers for such garbage disposal receptacles shall be flush with the surface of the ground. | |||||||
u. Landscaping. Those portions of all front, side and rear yards that are not used for off-street parking, access drives, or walks shall be attractively planted and maintained with trees, shrubs and grass lawns or other acceptable ground covers as set forth on a planting plan to be furnished by the developer at the time of application and approved by the Planning Board Special planting or a fence shall be provided along the side or rear property lines so that the parking area is not visible from adjacent residential properties.

v. Lighting. Reasonable yard lighting as approved by the Planning Board shall be provided to illuminate the premises at night. The wiring shall be laid underground and the lighting fixtures so arranged that the direct source of light is not visible from any residential area
| |||||||
w. Recreation. At least ten (10%) percent of the total lot area shall be improved for recreational purposes for the use of the tenants of the project in accordance with a plan specifying the types of improvements, which plan shall be furnished by the developer at the time of application and approved by the Planning Board Such recreational improvements may include, but are not limited to such things as tot lots, intermediate play areas, and swimming pools. No building permit shall be issued for a garden apartment building until a site plan shall have been submitted and approved in accordance with Section 19-4, Subdivision and Site Plan Review (Ord. #2-77, 195 1204) | |||||||

This zone district is designed for apartment residence use provided, however, a limited area of a building may be devoted to business or professional offices or retail business subject to the limitations, requirements and conditions hereinafter set forth (Ord. #18-83, 3) | |||||||

No building permit shall be issued for a building in this District until a site plan shall have been submitted and approved in accordance with Section 19-4, Subdivision and Site Plan Review, and until building construction plans and site plans thereof shall comply with all of the following requirements | |||||||

e. Floor Area Ratio The total gross floor area of all buildings shall not exceed sixty (60%) percent of the total lot area
| |||||||
f. Density of Development Buildings within the A-O-B Apartment-Office-Business District may be used exclusively for residential apartments or a combination of apartments and offices or retail business subject to the following limitations
| |||||||
1. If a building is used exclusively for residential apartments then not More than twenty (20) apartment units shall be permitted for each acre of land in the lot upon which an apartment building is to be located
| |||||||
2. If a building is to be used for both residential apartments and Offices or retail business, then and in that event, not more than thirty (30%) percent of the gross floor area of the building shall be used for offices For each one thousand two hundred fifty (1,250) square feet of gross floor area devoted to office or retail business uses, one (1) apartment unit shall be deducted from the total density of twenty (20) apartment units per acre

g. Rooms. For the purpose of this Section, a bedroom shall be construed to be any separate room other than a living room, dining room, kitchen or bathroom Each apartment unit shall contain as a minimum a separate bedroom, a separate living room, a separate bath and a separate kitchen, which kitchen facility shall be located separate and apart from the other rooms in the apartment unit. Only one (1) and two (2) bedroom units shall be permitted.

h. Minimum Floor Area All dwelling units shall conform to the following minimum floor area requirements exclusive of porches, staircases, casements, breezeways, balconies and attached garages:

1. One (1) bedroom units: five hundred (500) square feet
| |||||||
2. Two (2) bedroom units. seven hundred (700) square feet
| |||||||
i Parking There shall be provided not less than two (2) parking spaces for each apartment unit which may include garage space for the sole and exclusive use of the tenants Where a building is to be used for both residential apartments and office or retail business uses, there shall be provided not less than one (1) parking space for each two hundred fifty (250) square feet of gross floor area devoted to office use or two hundred (200) square feet of gross floor area devoted to retail business uses in addition to the parking spaces provided for residential apartments. All parking areas shall comply with the provisions of subsection 195 802 | |||||||
j. Access Drives. Access drives shall be installed providing adequate circulation within the apartment development as well as access to all parking areas and to public thoroughfares All access drives shall be paved and curbed to meet Township road specifications All access drives shall have minimum pavement width of twenty-four (24') feet for two (2) way circulation and eighteen (18') feet for one (1) way circulation.

This zone district is designed to provide sound, decent. attractive, and safe apartments restricted to low-income senior citizen households, as defined by the Council on Affordable Housing. [or as further regulated by funding sources.] Each development in this zone is also permitted to contain one (1) apartment for use by an on-site superintendent. This unit, which will contain not more than two (2) bedrooms, need not be age restricted, although it may in fact be income restricted in accordance with the administrative rules of the Council on Affordable Housing. | |||||||
| |||||||
Any use or structure customarily incidental to a principal permitted use. | |||||||
| |||||||
Any use other than listed in subsection 19-5.1201B is prohibited. | |||||||
| |||||||
No building permit shall be issued for a building in this District until, and unless a site plan shall have been submitted and approved in accordance with Section 19-4, Subdivision and Site Plan Review, and until building construction plans and site plans thereof shall comply with all of the following requirements: | |||||||
a. Height. No building shall exceed a maximum of three (3) stories. Cupolas, belfries, steeples, and other non-habitable architectural design features are permitted, in tact, encouraged, provided they do not exceed ten percent (10%) of the building's height.
| |||||||
b. Yards. No principal building shall be located closer than one hundred (100) feet to the front property line. Required side yard setback is seventy-five (75) feet. Required rear yard setback is fifty (50) feet. Accessory structures, recreation facilities and parking area are permitted in front. side, end rear yards, provided that no accessory structure, recreation facility or parking area shall project closer than forty (40) feet to any property line.

c. Minimum Lot Area. No senior citizen apartment building shall be constructed upon any lot containing an area of less than seven (7) acres. No lot which is intended to be developed for senior citizen rental housing shall have less than four hundred (400) feet of frontage.
| |||||||
d. Density of Development Buildings within this zone shall contain not fewer than fifty (50) apartments, and no more than seventy-five (75) apartments, all of which shall be restricted for low-income senior citizen households, as defined by the Council on Affordable Housing and applicable federal regulations, exclusive of the superintendent's apartment. All one (1) bedroom apartments shall be not less than six hundred (600) square feet; while two (2) bedroom apartments shall be not less then eight hundred (800) square feet.

e. Parking. There shall be provided not lass than .75 parking stalls per each apartment plus 10%. Parking lots shall be coated conveniently close to building entrances. Parking lot and driveway access shall comply with generally acceptable design standards for age-restricted housing. All parking areas shall comply with the provisions of subsection 19-5.803. The number of parking spaces reserved for handicapped drives shall be based on a recognized published standard for this type and quantity of housing.

f. Access Drives. Access-drives shall be installed which provide adequate circulation within the property. All access drives shall be paved and curbed to meet Township road specifications. All parking lot access drives shall have minimum pavement width of twenty-four (24) feet for two-way traffic and eighteen (18) feet for one-way traffic circulation. Primary site access drive(s) linking this site to a thoroughfare shall provide for a thirty-six (36) foot wide aisle it not provided with a center median, If a center median aisle is proposed, then each of the one-way lanes of traffic shall be twenty (20) feet in width.

g. Curbing. There shall be Belgian block curbs meeting Denville Township specifications around the perimeter of all parking areas and access drives.
| |||||||
h. Storm Drains. All parking areas and access drives shall be provided with an adequate system of storm drainage as approved by the Township Engineer.
| |||||||
i Walks. There shall be an adequate system of walks leading from all apartments to all parking areas, along access drives. and along front streets. All such walks shall be installed and constructed to Township specifications. | |||||||
j. landscaping. Those portions of all front, side, and rear yards that are not used for structures, off-street parking, access drives, gardens, or recreational amenities shall be attractively planted and maintained with native hardy trees, shrubs, and grass lawns or other ground covers as set forth on a planting plan to be furnished by the developer
