Prior to the subdivision or resubdivision of land and prior to the issuance of a building permit, zoning permit or certificate of occupancy, as the case may be for any use in the A-1 Apartment District or for any new structure, addition or alteration of an existing structure, the extension of any existing off-street parking facility or change in use in any non-residential district an application shall be submitted to and approved by the Planning Board in accordance with the requirements of this Article; except that subdivision or individual lot applications for detached one or two-family dwelling unit buildings shall not be construed to exempt individual lot applications for site plan approval in conjunction with development within the flood hazard areas nor for the requirement for site plans for two (2) or more lots in conjunction with subdivisions where topography or provisions for utilities may warrant consideration of a site plan. | |||||||
In the event the subdivision or site plan application requires action by the Board of Adjustment as provided in this Chapter, said application shall be submitted to and processed by the Board of Adjustment, which shall act to the same extent and subject to the same restrictions as the Planning Board as set forth in this Article. | |||||||
In cases where proposed alterations or changes in use will (a) not alter the nature or intensity of the use, and (b) not significantly alter the exterior of any building or buildings or other structures, and (c) comply with applicable provisions of Building Code of the Township of Denville, the Planning Board may by the adoption of proper rules, regulations and standards, which shall be based on the aforesaid three (3) conditions (a, b and c) make provision for and authorize a committee of the Planning Board upon receipt of adequate information from the applicant, to review and in proper cases and in accordance with the aforesaid rules, regulations and standards, waive the requirements of a formal site plan (Ord #2-77, 19-4 401, Ord #22-77, 1, Ord #9-81, 6, Ord #4-84, 13) | |||||||

An application for subdivision or site plan approval shall be filed with the Secretary of the Planning Board at least twenty-one (21) days prior to a regular meeting of the Planning Board (Ord #2-77, 194 402) | |||||||
| |||||||
Eighteen (18) copies of said application shall be submitted on forms available from the Secretary of the Planning Board, and shall be accompanied by eighteen (18) blue or black on white prints of the subdivision plat or site plan and eighteen (18) copies of any other required documents and improvement plans An application for final subdivision approval shall also be accompanied by the original tracing, two (2) translucent tracings and two (2) cloth prints of the subdivision plat In addition, one (1) additional print and one (1) reverse line sepia shall be submitted to the Morris County Planning Board by the applicant (Ord #2-77, 19-4 403, Ord #9-81, 7, Ord #7-93, 1) | |||||||

The application shall be accompanied by a filing fee as established by this Chapter to cover the administrative expenses involved in processing the application, by an inspection fee deposit and by a review fee deposit as established by this Chapter. | |||||||

An application for development shall be complete for purposes of commencing the applicable time period for action by a municipal agency when so certified by the municipal agency or its authorized committee or designee In the event that the agency, committee or designee does not certify the application to be complete within forty-five (45) days of the date of its submission, the application shall be deemed complete upon the expiration of the forty-five (45) day period for purposes of commencing the applicable time period unless (a) the application lacks information indicated on a checklist adopted by ordinance and provided to the applicant and (b) the municipal agency or its authorized committee or designee has notified the applicant in writing of the deficiencies in the application within forty-five (45) days of submission of the application The applicant may request that one (1) or more of the submission requirements be waived, in which event the agency or its authorized committee shall grant or deny the request within forty-five (45) days Nothing herein shall be construed as diminishing the applicant's obligation to prove in the application process that he is entitled to approval of the application.
