AN ORDINANCE TO ADOPT AN AMENDMENT TO THE HI TECH PARK REDEVELOPMENT PLAN TO ALLOW PLANNED ADULT COMMUNITY USE WITHIN A PORTION OF THE HI-TECH PARK REDEVELOPMENT AREA AND LI-LIGHT INDUSTRIAL ZONE WEST OF NJSH ROUTE 18, SPECIFICALLY VARIOUS LOTS IN BLOCKS 345 - 347, 350 - 355, 359 - 361, 361.01, 362, 363, 368 - 373, 378 -380, 383 - 390, 1000, 1006, REZONE LOT 27 BLOCK 1006 FROM R-2 TO LIGHT INDUSTRIAL AND AMEND THE ZONING MAP OF THE TOWNSHIP OF NEPTUNE COUNTY OF MONMOUTH | |||||||
WHEREAS, the New Jersey Local Redevelopment and Housing Law, N.J.S.A. 40A: 12A-1, et seq., authorizes the governing body to adopt by ordinance redevelopment plans, and amendments thereto, for areas in need of redevelopment; and, | |||||||
WHEREAS, the Township Committee adopted Ordinance number 00-56 on December 26, 2000 adopting a Hi Tech Park Redevelopment Plan in accordance with NJSA 40A:12A-1 et seq.; and, | |||||||
WHEREAS, the Township Committee approved a Redevelopment Agreement with Garden State Hi-Tech Park LLC on July 30, 2001; and, | |||||||
WHEREAS, the developability of the entire designated redevelopment area for planned office and light industrial use has not materialized due to changes in regional market demands following the severe economic downturn following September 11, 2001; and, | |||||||
WHEREAS the Neptune Township Planning Board has recommended changes to the Land Use Element of the Master Plan and Land Development Regulations to permit the development of a Planned Adult Community within a portion of the Hi-Tech Park Redevelopment Area and LI-Light Industrial Zone west of NJSH Route 18; and, | |||||||
WHEREAS, an amendment to the redevelopment plan was prepared by the Neptune Township Committee 's planning consultant, T& M Associates, and is entitled "Amendment to the Hi Tech Park Redevelopment Plan" ("Redevelopment Plan") dated November, 2005, a copy of which is attached hereto as Exhibit A; and, | |||||||
WHEREAS, on November 28, 2005, the Township Committee adopted Resolution No. 05-629 referring the Redevelopment Plan Amendment to the Planning Board for review and recommendation pursuant to N.J.S.A 40A-12A- 7; and, | |||||||
NOW THEREFORE BE IT ORDAINED, by the Township Committee of the Township of Neptune, as follows: | |||||||
SECTION 1 | |||||||
a. The amendments to the Redevelopment Plan are found to be consistent with the Township's Master Plan and the criteria for redevelopment plans set forth in N.J.S.A. 40A:12A-7.

b. The Township Committee has reviewed the amendments to the Redevelopment Plan and held a public hearing concerning the same to receive the comment of the public.

c. The amendments to the Redevelopment Plan attached hereto as Exhibit A for the Hi Tech Redevelopment Area is hereby adopted and will supersede the Neptune Township Land Development Ordinance to permit Planned Adult Community in accordance with the Amendment to the Redevelopment Plan and the Neptune Township Land Development Ordinance.

d. The zoning for Block 1006, Lot 27 is hereby amended from R-2 to Light Industrial.

SECTION 2 | |||||||
If any subsection, paragraph or provision of this ordinance is declared to be invalid by a court of competent jurisdiction, such finding shall not affect the remaining provisions of this Ordinance. | |||||||
SECTION 3 | |||||||
All ordinances or parts of Ordinances inconsistent herewith are hereby repealed. | |||||||
SECTION 4 | |||||||
This ordinance shall take effect twenty (20) days following adoption and approval and shall be published as required by law. | |||||||
