§228-260. Quorum; powers.

A.quorum shall consist of four (4) members The Chairman or, in his absence, the Acting Chairman shall have the power to issue subpoenas to compel the attendance of witnesses and the production of records and may administer oaths The Board shall perform all the duties and have all the powers provided by law to be exercised by boards of adjustment and shall determine the true location of any district boundary line and in addition thereto, pursuant to the statutes and subject to appropriate conditions and safeguards, shall determine and vary the application of the provisions herein established in harmony with their general intent and purpose to avoid practical difficulties or unnecessary hardships in a manner to secure the public health, safety and general welfare

§228-262. Handling of special exceptions.

Special exceptions or special questions as provided for in this chapter shall be considered pursuant to the provisions of N J R S 40 55-39b Whenever the Board is required to act after public notice and public hearing, the procedure shall be in the manner set forth in §228-261

§228-263. Actions requiring approval by both the Planning Board and Zoning Board of Adjustment.

Where the use which an owner, subdivider, developer or applicant (hereafter owner) intends to make of a parcel of land required approvals from both the Planning Board and the Zoning Board of Adjustment, the sequence of applications for such approvals shall be as follows

A.If an owner requiring subdivision approval also requires a variance with respect to lot size or dimensions, beyond the powers of the Planning Board, application shall first be made to the Planning Board for subdivision approval, and, if granted, application for a variance shall then be made to the Zoning Board of Adjustment The Planning Board may refer to the Zoning Board of Adjustment a recommendation with respect to the application for a variance, but any such recommendation shall not be binding upon the Zoning Board of Adjustment The Planning Board may not impose conditions upon the use of property, however, which would require an owner to apply for and obtain a variance not otherwise required by the proposed use
