ARTICLE IV Zoning District Use and Development Regulations
§196-10. Restrictions and controls.

The restrictions and controls intended to regulate development in each zoning district are set forth in the following Articles V, VI and VII, Schedules 1, II and III respectively, which are supplemented by other sections of this chapter.

§196-11. Application of regulations.

Except as hereinafter otherwise provided:

A. No building shall be erected and no existing building shall be moved, altered, added to or enlarged, nor shall any land or building be designed, used or intended to be used, for any purpose or in any manner other than as specified among the uses hereinafter listed as permitted in the zone in which such building or land is located.

B. No building shall be erected. reconstructed or structurally altered to exceed in height the limit hereinafter designated for the zone in which such building is located.

C. No building shall be erected, no existing buildings shall be altered, enlarged or rebuilt, nor shall any open spare surrounding any building be encroached upon or reduced in any manner. except in conformity with the yard, lot area and building location.

D. No yard or other open space provided about any building for the purpose of complying with the provisions of this chapter shall be considered as providing a yard or open space for any other buildings, and no yard or other open space on one lot shall be considered as providing a yard or open space for a building on any other lot.

E. No off-street parking area, loading or unloading area provided to meet the minimum off-street parking, loading or unloading requirements for one use or structure shall be considered as providing off-street parking, loading or unloading for a use or structure on any other lot.

F. No land in a residential zone shall be used to fulfill open space, parking or similar requirements for uses in nonresidential zones. No access shall be allowed through a residential zone to service a use in a nonresidential zone.

G. In residential conservation districts and historic overlay districts, no floor area in an existing residential building shall be altered to off-street parking space or for access thereto. [Added 11-14-88 by Ord. No. P-25; amended 6-21-89 by Ord. No. P-58]

H. All residential buildings whether newly constructed or substantially altered shall be subject to the regulations of Section §196-26.3: Building Facade, whether or not they are subject to review and approval by either the Planning Board or Zoning Board of Adjustment for site plan or variance requests.

§196-12. General use restrictions.

Any use not designated as a principal permitted use, a permitted accessory use or a conditional use is specifically prohibited from any zoning district in the City of Hoboken.

§196-13. General regulations.

A. Cross-reference.

(1) Section references in parentheses indicate specific regulations pertaining to a specific use.

(2) Off-street parking and loading requirements are detailed in Article XI, § 19645.

(3) All uses, other than those exempted in § 196-26, must comply with site plan review.

(4) All conditional uses are governed by regulations set forth in Article X.

(5) Lot, height and yard regulations may vary under special circumstances noted in Article VIII.

B. District regulations. Articles V, VI and VII set forth use and density regulations by zoning district.

C. Historic site regulations. Article IX sets forth the standards for review of historic sites or property in historic subdistricts by the Historic Preservation Commission. [Added 3-2-1991 by Ord. No. P-136]
