ARTICLE XII Supplementary Regulations

§296-52. Rooming houses, boarding homes and boarding homes for sheltered care .

A.The number of rooming houses, boarding homes and boarding homes for sheltered care, regardless of referral source or statutory classification of clientele, shall be limited to housing either one (1) person per five-tenths percent (0.5%) of the population of the municipality or one hundred (100) people collectively residing in such homes within the township, whichever is greater. B. No rooming house, boarding home or boarding home for sheltered care may be located within one-half (1/2) mile [two thousand six hundred forty (2,640) feet] of an existing rooming house, boarding home or boarding home for sheltered care.

C. Upon enactment of this section, the township shall apply to the Commissioner of the Department of Community Affairs for authorization to perform such inspections of rooming houses, boarding homes and boarding homes for sheltered care as identified herein. [Amended 9-28-83 by Ord. No. 0-15-83]

§296-52B. Home occupations.

Home occupations incident to an otherwise lawful use of residential premises shall adhere ' to the minimum standards of a particular zone and shall also meet the following criteria:

A. The use shall be one which is customarily incidental to the use of the premises as a dwelling and subordinate to the residential use of the property.

B. There shall be no more than one (1) employee working on the premises other than the bona fide residents of the dwelling.

C. That portion of the dwelling unit utilized for the home occupation shall not exceed thirty percent (30%) of the total floor area of said dwelling unit.

D. The occupation shall be conducted entirely within the dwelling or within an existing accessory building or buildings.

E. No related displays of articles for sale shall be visible from the street.

F. Only articles made on the premises may be sold.

G. No sign shall be larger than two (2) square feet on each of two (2) sides.

H. There shall be no external change to the premises or its buildings unless said change continues the appearance of the property's principal use.

I. No mechanical equipment may be used except that which is normally used for purely domestic or household purposes.

J. In no case shall any home occupation require parking to occur on the adjacent residential streets.

K. Not more than four (4) off-street parking spaces shall be allowed for the residential plus home occupation use.

L. Buffers may be required based on the location of any new parking areas.
