ORDINANCE NO. 1635 ZONING MAP AMENDMENT

AN ORDINANCE TO AMEND EXHIBIT A OF ORDINANCE NO. 1561 OF THE CODE OF THE TOWNSHIP OF MAHWAH TO CORRECT TYPOGRAPHICAL ERRORS IN DESCRIBING THOSE PORTIONS OF LOTS 118 AND 120 IN BLOCK 173 WHICH RE-ZONED PORTIONS FROM A GENERAL -INDUSTRY (GI-80) ZONE TO A RESIDENTIAL (R-10) ZONE

WHEREAS, the Township Council of the Township of Mahwah adopted Ordinance 1561 which Ordinance became effective on February 7, 2007; and

WHEREAS, said Ordinance rezoned Lot 119 and portions of Lots 118 and 120 in Block 173 to a Residential (R-10) zone; and



WHEREAS, a more specific description of the affected portions of said Lots 118 and 120 in Block 173 was attached as "Exhibit A" to said Ordinance 1561; and

WHEREAS, it appears that said "Exhibit A" to Ordinance 1561 contained typographical errors in connection with those portions of Lots 118 and 120 in Block 173 which were affected by Ordinance 1561 which the Township Council desires to correct.

WHEREAS, that a new "Corrected Exhibit A" be prepared by Boswell McClave Engineering entitled "Description of a Portion of Lot 118, Block 173, Township of Mahwah, Bergen County, New Jersey" and "Description of a Portion of Lot 120, Block 173, Township of Mahwah, Bergen County, New Jersey" both dated January 20, 2009 both dated January 20, 2009 be and hereby are substituted for "Exhibit A" of Ordinance 1561.

NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township of Mahwah, County of Bergen, State of New Jersey that Ordinance No. 561 be amended to reflect that the entirety of Lot 119, Block 173 remains in Residential (R-10) zone and those portions of Lots 118 and 120, Block 173 not specifically addressed in "Corrected Exhibit A" remain in General Industry (GI-80) zone. In all other respects the terms of Ordinance -1561 remain in full force and effect; and

BE IT FURTHER ORDAINED that all Ordinance or parts of Ordinances that are inconsistent with the provisions of this Ordinance are hereby repealed, but only to the extend of such inconsistencies; and

BE IT FURTHER ORDAINED that the provisions of this Ordinance are severable. If any part of this Ordinance is declared to be unconstitutional or invalid by any Court, the remaining parts of this Ordinance will remain in full force and effect; and

BE IT FURTHER ORDAINED that all other aspects of Ordinance No. 1561 of the Township of Mahwah remains the same; and

BE IT FURTHER ORDAINED that this Ordinance shall become effective after final passage, adoption and publication as required by law.

BEGINNING at a point on the southerly line of Fairmount Avenue, (50.00 feet wide) where the same is intersected by the division line between Lot 117 and Lot 118 in Block 173, said point being located N 83 degrees 31' 00" E, a distance of 252.77 feet from the intersection of the said southerly line of Fairmount Avenue and the easterly line of Jefferson Street (50.00 feet wide), and running thence;



1. Along the said southerly line of Fairmount Avenue, N 83 degrees 31' 00" E, a distance of 126.39 feet to a point, thence;

2. Along the division line between Lot 118 and Lot 119 in Block 173, S 2 degrees 00' 50" W, a distance of 100.00 feet to a point, thence;

3. Through said Lot 118 in Block 173, S 83 degrees 31' 00" W, a distance of 126.39 feet to a point, thence;

4. Along the aforementioned division line between Lots 117 and 118, N 2 degrees 00' 50" E, a distance of 100.00 feet to the point or place of BEGINNING.

Containing 12,500 square feet or 0.2870 acre.

2. Along the division line between Lot 120 and Lot 121 in Block 173, S 1 degree 15' 30" E, a distance of 100.00 feet to a point, thence;
